Faridabad Court sentences one to life imprisonment for murdering wife, son

JAMMU, Mar 9:  In a recent land mark judgment, Rajesh Malhotra, Additional Session Judge Faridabad, Haryana has sentenced to life imprisonment one Kuldeep Dhar S/o Makhan Lal Dhar of Sector 2 Gangyal P S Gandhi Nagar, Jammu at present House No 2247, Sector 3, Faridabad for murdering his wife and son.
After hearing the arguments of the Council for accused and public prosecutor, the court upheld that accused was involved in the coldblooded murder of his wife, Saroj and son, Krishna on July 29, 2015 and sentenced him to imprisonment for life under Section 302 IPC and to pay a fine of Rs 10,000 & in default of fine he has to undergo a simple imprisonment for 30 days under IPC 309.
The brief history of the case is that FIR No 451 of 30.7.2015 under Section 302 and 309 of IPC was registered with Police Station, Sector 7, Faridabad on the complaint of one Bal Krishan. In his complaint Bal Krishan stated that on July 29, 2015 when he repeatedly tried to contact Kuldeep on his mobile phone, the same was switched off and thereafter along with Sudhir Dhar and two friends of Kuldeep he reached the House No 2247 Sector 3 Faridabad were Kuldeep and his family were putting up.
He further stated in his complaint that all the doors of the house were closed from inside. Later, the matter was informed to the police as they had suspected that some one is inside the room. Thereafter they broke open the door ad found that the door was closed from inside and all the household articles were lying scattered and blood was present on the spot. When they broke open the door of the inside room, they found Kuldeep, Saroj and their son Krishna were lying on the floor and Kuldeep was lying in pool of blood due to number of injures and his wife Saroj and son Krishana were lying dead.
They suspected that Kuldeep after killing his wife and son had inflicted injuries on his body. Prayer was accordingly made to take legal action. After registration of FIR investigation was conducted by police and accused was arrested during investigation. On completion of investigation report under Article 173 CrPC was forwarded to court for trial against the accused for commission of offence under Section 302 /309 of IPC.
Kuldeep however pleaded innocence and claimed trial.
However, Additional Session Judge while giving judgment maintained that “I am of the view that the present case is not rarest of the rare case in any manner”. Accordingly seeing facts and circumstances of the case, the Judge sentenced the accused/ convict to life imprisonment.
