DB upholds life-imprisonment to Army jawan for killing wife

JAMMU, Apr 15: Division Bench of High Court comprising Justice Virender Singh and Justice Janak Raj Kotwal upheld the life-imprisonment to Army Havaldar Mangla Kumar for killing his wife.
According to the police case, on November 24, 2002 one Naib Subedar submitted a written report in Police Station Gandhi Nagar that one D B Joshi made a telephonic call from CMP gate to the effect that the Bindu, wife of accused had sustained burn injuries and shifted to Military Hospital Satwari.
On this, police reached the hospital and recorded the statement of Bindu, who stated that she was set ablaze by her husband. Later, Bindu succumbed to injuries and accordingly a case FIR No. 381/2002 under Section 302 RPC was registered.
After completion of the investigation, challan was presented in the Court which was decided on October 16, 2012 and Court awarded life-imprisonment to the accused. The life-imprisonment was later challenged in the High Court.
After hearing Advocate Ravi Abrol for the accused whereas Deputy AG DS Jamwal for the State, the DB observed, “we are satisfied and convinced that the dying declaration made by the deceased Bindu is true. Therefore, there is no legal impediment to make it basis of conviction of the accused for the charge under Section 302 RPC”.
With these observations, DB upheld the life-imprisonment awarded by the Trial Court.
