JAMMU, Mar 6: Division Bench of State High Court comprising Justice Mohammad Yaqoob Mir and Justice BS Walia today set-aside the life-imprisonment awarded by Trial Court in a murder case and acquitted the accused.
The Trial Court had awarded life imprisonment to Darshan Singh and Amrit Kour for allegedly setting ablaze Manmeet Kour (wife of Darshan Singh) for want of dowry.
“Flaws have not been properly taken care of by the Trial Court meaning thereby that the evidence has not been appreciated properly”, the DB said, adding “it is in view of that position, we have undertaken the exercise of reading the entire evidence and have found that the flaws and defects which demolished the prosecution case have not been taken note of by the Trial Court”.
With these observations, Division Bench reached to a firm conclusion that the guilt against the accused has not been proved beyond shadow of doubt. Therefore, the accused were acquitted.
