DB issues notices to CS, GAD Secy in plea seeking shifting of IAS officer

JAMMU, Dec 11: In the much publicized Public Interest Litigation (PIL) highlighting alleged hushing up of Rajouri Development Authority scam, Division Bench of the State High Court comprising Chief Justice  Bader Durrez Ahmed and Justice Sanjeev Kumar today issued notices to Chief Secretary,  Commissioner Secretary, General Administration Department and Mohd Javed Khan, the then Chief Executive Officer Rajouri Development Authority and presently Excise Commissioner.
Through these notices they have been asked to submit their response by or before February 14, 2018 in a Miscellaneous Petition seeking directions for shifting IAS officer Mohd Javed Khan from the post of Excise Commissioner to any other non-sensitive post till the conclusion of the regular departmental enquiry.
When the Public Interest Litigation (PIL) came up for hearing, Advocate Sheikh Shakeel Ahmed with Advocates  Rahul Raina, Suraj Singh and Supriya Chouhan appearing for the petitioner submitted, “the competent authority in the General Administration Department after the conclusion of the preliminary enquiry decided to hold regular departmental enquiry against the delinquent IAS officer for his various acts of omissions and commissions and as per the last status report filed by the GAD a memorandum containing articles of charges and statement of imputations in support of the charges was served upon Mohd. Javed Khan in October 2017, for submitting a written statement of defence within 21 days”.
“On the last date of hearing, the Division Bench had granted four months time to the GAD to conclude the regular departmental enquiry  against the delinquent IAS officer. Moreover, on the last date of hearing  it was orally submitted that in view of initiation of regular enquiry against Mohd Javed Khan he is required to be shifted from the coveted post of Excise Commissioner in view of the law laid down by the Apex Court of the country”, Advocate Ahmed said, adding “as asked by the Division Bench a proper application in this regard has been filed”.
After considering the submissions of Advocate Ahmed and taking cognizance of the fresh Miscellaneous Application, the Division Bench issued notices to the Chief Secretary, Commissioner Secretary GAD and delinquent IAS officer Mohd Javed Khan requiring them to submit their response by or before February 14, 2018.
