DB dis-satisfied with affidavits

JAMMU, Jan 29: In the much publicized Public Interest Litigation challenging the registration of FIR against Mobile Magistrate without adhering to the Supreme Court guidelines, Special Division Bench of the High Court comprising Justice Mohammad Yaqoob Mir and Justice Bansi Lal Bhat today took serious note of the affidavits filed by IGP Kashmir Zone and SHO Police Station Sopore.
When the PIL came-up for hearing, Advocate Rohit Kapoor appearing for the petitioners—-two young advocates namely Rajnish Raina and Prem Sadotra, pointed out, “the affidavits filed by IGP Kashmir and SHO Sopore are aimed at justifying the wrong committed by the police”, adding.
After going through the affidavit filed by SHO Sopore and IGP Kashmir and hearing Advocate Rohit Kapoor for the PIL whereas AAG HA Siddiqui, Division Bench observed, “AAG HA Siddiqui has sought time to file appropriate affidavit, which is granted”, adding “the appropriate affidavits shall be filed within 10 days”.
Accordingly, the DB directed Registry to list the PIL on February 7, 2014.
