DB directs State to modify order on grades to Secys of CJ, Judges

JAMMU, Dec 16: In a contempt petition filed by Secretaries of Chief Justice and Judges of the High Court against non-implementation of  the judgment whereby they were held entitled to grades equivalent to KAS, Division Bench of High Court comprising Chief Justice N Paul Vasanthakumar and Justice Tashi Rabstan today directed the State to modify the order dated December 13, 2016.
When the matter came-up for hearing, Senior AAG Seema Shekhar produced Government Order No.3398-LD (A) of 2016 dated December 13, 2016 according sanction to the creation of two posts of Secretaries in the Selection Grade and three posts of Secretaries in the Special Scale with effect from the date of passing of order.
Upon this, Division Bench said that proposal submitted by the High Court pursuant to the directions given by the Division Bench states that sanction to the creation of posts be accorded with effect from the date when the incumbents became eligible for the upgraded scales, that was December 1, 2008.
After hearing Senior Advocate Sunil Sethi for the petitioner, DB granted two week’s time to the Government for modification of Government Order No.3398-LD (A) of 2016 dated 13.12.2016.
