DB directs DGP to file affidavit

JAMMU, Dec 26: Division Bench of State High Court has directed the Director General of Police (DGP) to file an affidavit indicating the plan of action to control the menace of drugs in the State.
The direction has been issued in a Public Interest Litigation filed by Atharv Mahajan and Court on its Own Motion regarding low conviction rate and acquittal in many of NPDS case.
After hearing Advocate Deepika Mahajan for the PIL whereas Advocate Sanchit Verma for the State, the DB observed, “many of the cases under the Narcotic Drugs and Psychotropic Substances Act are ending up in acquittal because of shoddy investigation and lack of knowledge on the part of the police officials for compliance of the requirements under the law”.
“In many cases physical recoveries are not produced before the courts and there is no evidence to indicate as to what happened to the narcotics and psychotropic substances, whether they were disposed of at all as required under law”, the DB said, adding “this is a very serious issue, which needs to be tackled and the police personnel have to be specialized to deal with the cases under the NDPS Act”.
