DB directives to JMC on mobile towers

JAMMU, Nov 6: In a Public Interest Litigation (PIL) filed by a law student Navyug Sethi seeking shifting of mobile towers from the residential areas, Division Bench of State High Court comprising Justice Alok Aradhe and Justice Tashi Rabstan has directed Jammu Municipal Corporation to submit particulars of all the permissions granted by it for installation of mobile towers in Jammu city.
“This court by an ad-interim order dated 10.07.2017 had directed the Municipal Corporation, Jammu to ensure implementation of the ‘Guidelines for Installation of Communication Towers, 2016’ and submit the compliance report. The Jammu Municipal Corporation, has filed the preliminary objections, in which, inter alia, it has been stated that after coming into force the guidelines, 25 permissions were granted in accordance with the criteria”, the DB observed.
On this, Senior Advocate Sunil Sethi submitted that 525 mobile towers have already been installed prior to the guidelines, which are causing serious health hazards to the residents of Jammu.
In view of the submissions of Senior Advocate Sunil Sethi, the DB directed Jammu Municipal Corporation to submit particulars of all the permissions granted by it for installation of mobile towers in Jammu city along with necessary particulars including the locations of the towers. “The Corporation shall also indicate as to how many mobile towers are existing in violation of the guidelines”, the DB added.
