DB denies bail to HM ultra

JAMMU, May 16: In the much publicized murder case of Sarpanch Sher Mohammad in which Trial Court had awarded life-imprisonment and fine of Rs 5000 to HM terrorist namely Tariq Mattoo of Gandoh, Division Bench of State High Court comprising Justice Alok Aradhe and Justice Janak Raj Kotwal has rejected the bail application of the ultra.
After hearing Advocate Rozina Afzal for the accused whereas Senior AAG Seema Shekhar for the State, Division Bench observed, “no doubt the Supreme Court has held that where the appellant has served the half of the jail sentence, the appellant should normally be released on bail”.
“Section 497-D of the Code of Criminal Procedure does not apply in this case for the reason that the Section excludes offences for which imprisonment for life is provided”, the DB said, adding “the appellant was absconding and apprehended after filing of the charge sheet and two of the co-accused are still absconding”.
With these observations, DB rejected the bail application.
