DB decides 19 yrs old appeal, upholds life-imprisonment

JAMMU, July 11: Division Bench of State High Court comprising Justice Mohammad Yaqoob Mir and Justice Janak Raj Kotwal today decided 19 years old appeal and upheld the life-imprisonment and fine of Rs 50,000 awarded by the Trial Court to one Mohd Sadeeq.
According to the prosecution case, one Babli  fell in love with Mohd Sadeeq and finally they entered into wedlock in the year 1991 against the wishes of their parents. Their love, however, did not last long and in the year 1994, they decided to part ways. The accused divorced the deceased by virtue of a written deed.
Even after divorce, the accused, however, continued visiting the deceased at her place of residence despite protest by her. On April 6, 1994 the accused came to the residence of the deceased at 7 PM and set her ablaze by pouring kerosene oil.
After hearing both the sides, the DB observed, “prosecution has succeeded in proving beyond any doubt the presence of the accused along with the deceased in the room in which the occurrence took place. Moreover, prosecution has succeeded in proving the dying declaration of the deceased in which she inter alia stated that she was set on fire by the accused after dousing her in kerosene from the stove lying in the room”.
“The facts thus proved are sufficient to connect the accused with the commission of offence, that is, setting the deceased ablaze and thereby causing her death. We, therefore, find no ground for disagreeing with the judgment of conviction recorded by the Trial Court”, the DB said while upholding the life-imprisonment.
