DB asks Law, Finance Deptts to take decision

Pay parity of staff of High Court

JAMMU, Oct 22: Division Bench of the State High Court comprising Justice Dhiraj Singh Thakur and Justice Sindu Sharma today directed Law and Finance Departments to take decision with regard to the pay parity of the staff of the High Court based upon the data already provided by the High Court on the basis of 6th Pay Commission.
DB made it clear that since the matter has been pending for a considerable period of time, it is hoped that next time no further adjournment would be sought on one pretext or the other and final decision taken by the Government shall be placed before the court.
About the prayer with regard to benefit under SRO 386, which has not been given retrospectively in case of the Bench Secretaries of the High Court, the DB directed that a decision be also taken by the Government in this regard and Senior AAG H A Siddiqui shall also file a detailed status report in this regard on the next date of hearing.
Earlier, after going through the status report, the DB observed, “Senior AAG HA Siddiqui submits that more clarification is required from the High Court with regard to the data based upon the 7th Pay Commission and its financial implications”, adding “we feel that what is urged by Senior AAG and reflected in the status report was totally unnecessary. A decision if taken on the basis of a data based upon the 6th Pay Commission would have been good enough for purposes of determining the rights of the petitioners”.
Joginder Singh, petitioner appearing in person, submitted that once the rights of the staff are determined on the basis of the data prescribed on the basis of 6th Pay Commission it would certainly ensure for determining the rights of the petitioners under the 7th Pay Commission as well.
Upon this, DB directed that a decision shall be taken by the Law Department as well as the Finance Department with regard to the pay parity of the staff of the High Court based upon the data already provided by the High Court on the basis of 6th Pay Commission.
