Court rejects bail of Peer, 14 others

Srinagar, Oct 1: Jammu and Kashmir High Court today rejected 15 bail applications including that of former Board of Professional Entrance Examination (BOPEE) Chairman Mushtaq Ahmad Peer, accused involved in paper leak scam.
The Division Bench comprising Chief Justice MM Kumar and Justice Mohammad Yaqoob Mir rejected the bail application of Peer and 14 other persons who are being jailed (FIR No. 24/2013 under Sections 420, 406, 201 and 120-B under prevention of corruption Act).
The court while dismissing the bail applications of these accused said that the investigation is still on. “Therefore at this stage grant of bail shall be detrimental to further investigation of the case regarding other conspirators as such petitioner does not deserve any concession of bail”,  Bench directed.
Court while rejecting the bunch of bail applications observed: “The magnitude of the crime committed can be analyzed from other angle that is the money power will have preference over all other claims. The merit, hard work, genuine hope, expectations and fair selection have become casualty.”
Court further said that lakhs of rupees have been spent which facilitated that fraudulent selection of non meritorious candidates.
“Allegedly lakhs of rupees have changed hands which facilitated the fraudulent selection of a number of candidates for pursuing the course of MBBS, BDS and other courses. The merit has become casualty and this fraud disheartened the aspiring candidates”, observed the Bench.
The Court observed that it is alleged that in lust of making money, Peer has crossed all limits as a result secrecy, efficacy, transparency and image of Board(BOPEE) has been brought down in society. “It will take time to repair the loss and restore the faith in CET”, observed the Bench.
