JAMMU, Mar 30: Judicial Magistrate Bishnah Archana Charak today rejected the bail application of one Ajay Kumar, who was involved in kidnapping of a minor.
After hearing PO Altaf Wahid for the State whereas Advocate SS Manhas for the accused, the court observed, “prosecutrix is a minor girl as such question of consent does not arise”, adding “undoubtedly the minor girl is to be protected under the law as there are number of incidents of sexual abuse of minor girl and therefore there is a legislation of POCSO and amendment in Section 375/376 of Indian Panel Code”.
“The Judiciary takes a very serious note of offences against women and especially against the minor girl. In the present case, facts are clear that prosecutix is a minor girl and legally she is below the age of consent”, the court said while rejecting the bail application.
