Court directs SSP to remove Incharge Police Post Kahra

JAMMU, July 27: Principal Sessions Judge Bhaderwah MK Sharma has directed SSP Doda to immediately remove Incharge Police Post Kahra and enquire into the allegations leveled against him.
This significant direction was passed by the court after going through the statement of prosecutrix recorded under Section 164-A CrPC. The prosecutrix in her statement recorded before the Magistrate stated that after her recovery from the clutches of the accused, the Incharge Police Post Kahra kept her in his room for a night and made unsuccessful attempt to enter the room. She further stated that Incharge Police Post also abused her.
After going through the statements of the prosecutrix, the court observed, “it is true that Section 161 CrPC confers powers on the police to interrogate any witness. However, no male person below 15 years or above the age of 65 years or a woman or a physically or mentally disabled person can be called to the police station for investigation”.
“In this age of 21st century with growing demands for human rights friendly police and judicial administration, the act of the Incharge Police Post Kahra attributed to him by the prosecutrix is not only reprehensible and unbecoming of a police officer but also warrants legal action”, the court observed and directed SSP Doda to immediately remove Incharge Police Post Kahra from his present place of posting and enquire into the allegations leveled against him by the prosecutrix.
“If the circumstances warrant registration of a separate case against the officer or his impleadment as accused in the case then SSP shall proceed ahead as warranted under law”, the court said.
