Court denies pre-arrest bail to XEn in Rs 2.53 cr scam

JAMMU, Jan 18: Special Judge Anticorruption Jammu Puneet Gupta today rejected the pre-arrest bail application of Sunil Gupta, the then Executive Engineer R&B Special Division Mahore, who was allegedly booked by the Vigilance Organization in Rs 2,53,87,520 alleged scam.
According to the Vigilance case, FIR No.17/2013 under Section 5(1) (d) r/w 5 (2) PC Act 2006 and 120-B RPC was registered against Sunil Gupta, the then Executive Engineer, (R&B) Special Sub-division, Mahore and others on the basis of a verification.
During the verification, it came to fore that the Executive Engineer had abused his official position and allotted 162 works to his blue-eyed contractors under the garb of departmental execution. Moreover, he got works amounting to Rs 2.53 crore executed departmentally by deliberately fragmenting them in parts so as to bring them within financial competence and undue benefit has been conferred upon blue-eyed contractors by first allotting them work without inducing any competition and further releasing payments in their favour without deducting service tax from their payments.
After hearing CPO Vigilance Harminder Singh for the State, Special Judge Anticorruption observed, “the allegations leveled against the accused are serious and it cannot be said that the custodial interrogation may not be required for the same”, adding “other officials of the department may also be involved. It needs no reiteration that the menace of corrupt practices has assumed alarming proportion in the society and is required to be dealt with firmly”.
Accordingly, the pre-arrest bail of Sunil Gupta was dismissed.
