Court denies bail to 2 in kidnapping, rape case

JAMMU, Aug  23: Chief Judicial Magistrate Kathua Amarjeet Singh Langeh today rejected the bail applications of  Ranbir, son of Major Singh and Ranjeet Singh, son of Hari Singh, both the residents of  Kathua, who were allegedly involved in kidnapping and rape with a school going minor girl.
“The investigation reveals that Ranbir who happens to be a conductor with a bus used to frequently talk her in school and on August 4, 2017 the prosecutrix was kidnapped from school and ultimately taken to Chandigarh where according to her, she was raped”, the court observed.
“To stalk, harass, kidnap and then to commit sexual assault on a minor girl is undoubtedly heinous and grave act. Incidents involving constant stalking of school going minor girls culminating in their kidnapping and sexual assaults may not be a menace as of now but for sure is a worrying/ disquieting trend in present day scenario”, the court further said, adding “this aspect cannot be over looked”.
“It is also worthwhile to mention that one co-accused is yet at large. Investigation is at initial stage. All these circumstance tilt heavily against petitioners in so far as grant of bail is concerned, more particularly when offence under Section 376 of RPC carries punishment up to life imprisonment and when prosecutrix happens to be minor”, the court said, adding “rigour of proviso to Section 497-C is also attracted in the case at hand on facts”.
With these observations, court rejected bail application.
