Cop acquitted of rape charges as prosecution failed to prove case

JAMMU, July 14: Principal Sessions Judge Poonch, Jaffer Hussain Beigh has acquitted a police constable namely Imtiaz Ahmed, son of Mohd Younis of Mendhar, who was facing rape charges as prosecution failed to prove the case.
According to the police case, on February 12, 2007 the alleged accused after enticing prosecutrix to marriage with criminal intention committed rape upon her. On her complaint, police registered a case and after completion of investigation challan was presented.
After hearing both the sides, Principal Sessions Judge observed, “as stated by the prosecutrix the accused also made promise for marriage with her, in such circumstances the promise loses all significance, particularly when they went from bus-stand to the hotel, the prosecutrix herself spent night in the hotel with the accused without any resistance and succumbed to the temptation of having sexual relationship”.
“If the statement of the prosecutrix is taken as it is, the prosecutrix willingly consented to having sexual intercourse with the accused with whom she accompanied to the hotel, not because he promised to marry her, but because she also desired it”, the court said.
With these observations, court dismissed the challan produced by the police and acquitted the accused of the charges leveled against him.
