Governor seeks action, HC stays order

Srinagar, Oct 28: The Controller of Examinations of fraudulent selections in Khadi and Village Industries Board (KVIB) has issued an advertisement for filling up of 28 posts in the Jammu and Kashmir Legislative Council, with Governor, Satya Pal Malik, seeking action and High Court staying the selection process.
Abdul Majid Bhat, Secretary Law who holds Additional charge of Secretary LC, and was Controller of botched up Examinations of KVIB, interestingly has given the contract for the conduct of the examination for recruitments in the LC to M/S LM Energy and Software Pvt. Limited F-23 Green wood city Sector-46 Gurgaon Haryana. It is the same company that conducted the examination of the KVIB where relatives of politicians were appointed instead of deserving candidates.
The Governor has sought clarification (No. GS – J(GR) 18/299 dated 13 September 2018) from Secretary Legislative Council on the issue. “Request for referring the vacant posts advertisement notice No. Legislative Council /Estt/Advt.No.01/2018 dated 04-09-2018 issued by Legislative Council to Jammu and Kashmir Service Selection Board for making selections – Representation thereof. In this context, I am desired to forward the said representation for appropriate necessary action in the matter”, read the communication.
The High Court has also stayed (No. 34577 dated 13-09-2018) the recruitment notice issued by the LC and matter is sub-judice. Law Secretary was asked by the High Court to furnish his reply on October 15 but he failed to do so and now has been asked to file it on November 5.
Despite Governor seeking action and HC staying the process, the Legislative Council has gone ahead with the process of inviting on-line applications, with aspirants smelling rat and KVIB like recruitments.
The recruitment process of the LC is also against the recent circular issued by the GAD under the orders of Governor. The circular (No. GAD/MTG/RB-IV/26/2018 dated 15-09-2018) reads: “…Governor hereby directs that the selection of Class-IV posts borne on establishment of all Government Departments shall be made solely on the basis of written examination to be conducted by SSB.”
The 28 posts advertised (LEGISLATIVE COUNCIL/ Estt/Advt.No.01/2018 dated:- 04-09-2018) are three Junior Scale Stenographers, one Translator, one Reporter, one Junior Librarian, four Pass Cum Reception Clerks, two Copyists, one Dispatch Rider, two Watch and Ward man, two Watch and Ward women, one Jamadar, nine Watch and Ward Assistants and one Sweeper.
Last year, 16 posts were created in the LC (Govt order No. 5366-LD(PAB) of 2017 dated 25-10-2017), out of which Accounts Officer, Assistant Information Officer, Junior Legal Assistant and Junior Librarian were to be brought from other departments on deputation. But, in clear violation of his own orders (as Law Secretary), Abdul Majid as Secretary LC adjusted Translator, Javed Ahmad Parray, as Assistant Information Officer and Reporter, Mudasir Wani, as Junior Legal Assistant while post of Junior Librarian was Advertised.
It may be mentioned here that Legislative Council made 28 appointments in 2014 and majority of them were either relatives of politicians or of their aides. Two of them who were appointed as Reporters – Mudasir Rasool Wani and Saqib -are close relatives of then Law Minister, Saifullah Mir.
