Bail denied to rapist of mentally retarded girl

JAMMU, June 7: Presiding Officer Fast Track Court Sanjeev Gupta rejected the bail application of one Sohan Singh, who was facing trial for committing rape with a mentally retarded girl.
According to the police case, President of J&K Handicapped Welfare Association, Akhnoor lodged a complaint with Police Station Akhnoor mentioning that some unknown youth raped mentally retrarded girl and now she is pregnant. On this complaint, police registered a case and after completion of investigation presented challan in the court.
After hearing Additional Public Prosecutor, Presiding Officer Fast Track Court observed, “the societal concern has to be kept in view in juxtaposition of individual liberty”, adding “social concern in the case is required to be given priority over lifting the restriction of liberty of the petitioner”.
With these observations, court denied bail to the accused.
Meanwhile, Special Municipal Mobile Magistrate Jammu Kamlesh Pandita rejected the bail application of one Bachan Lal, who was arrested by the police in attempt to rape with minor.
After hearing both sides, Special Municipal Mobile Magistrate observed, “the investigation is still going on and the bail to the accused person would definitely give wrong signal in the society and in other way shall also encourage the person who are contemplating the same”.
With these observations, Court rejected the bail application of the accused.
