Accused in rape case acquitted as prosecutrix turns hostile

JAMMU, Jan 11: Presiding Officer of Fast Track Court Sanjeev Gupta today decided a rape and kidnapping case within the short span of three months and acquitted accused Rakesh Singh, son of Onakar Singh of Rajpura Pargwal, Akhnoor of the charges leveled against him as prosecutrix become hostile.
While acquitting the accused person, Presiding Officer observed, “from the perusal of evidence of prosecutrix, there is nothing to suggest that accused had committed the offence with which he has been charged because prosecutrix has specifically stated during the course of testimony that the accused has neither done any bad act with her nor cheated her”.
“In these circumstances, the court is left with no option but to truncate the proceedings against the accused at this stage because it will be futile exercise to summon other witnesses cited in the challan, which will only prolong the trial of the case”, Presiding Officer said and directed that the accused shall be released forthwith if not required in any other case.
