18 sitting MLAs on verge of hattrick

BHOPAL, Nov 13: For 18 sitting legislators testing their electoral fortunes from the Chhattisgarh region in the November 25 assembly elections in Madhya Pradesh, a victory could earn them a hattrick or two in the electoral arena.

While some like Congress veteran Shyama Charan Shukla and Minister Chanesh Ram Rathi are on the verge of a double hat-trick, several others like BJP state president Dauram Ratnakar are trying to notch up their first hattrick.

Of these 18 legislators, nine belong to the Bharatiya Janata Party (BJP), seven are from Congress and one each from Bahujan Samaj Party (BSP) and Communist Party of India(CPI).

Mr Shyama Charan Shukla, who had already scored a hattrick from Rajim seat during 1962 to 1972, is now working diligently to attain a distinction of a two time hattrick scorer as he had won his traditional seat in 1990 and 1993 elections.

State Minister Chanesh Ram Rathia, who has been consecutively won the Dharamjaigarh assembly seat in the last five Vidhan Sabha polls, is trying his luck in the same constituency in pursuit of a double hat-trick.

Besides, sitting Congress legislators in the queue to notch up their first hat-trick include Mr Ashok Rao(Bilha), Mr Ramchandra Singh Deo (Baikunthpur), Mr Aand Kumar Patel(Kharasia), Mr Madhava Singh Dhruve (Sihava), and Ms Gita Devi Singh (Dongargaon).

Another Congress leader and Minister in the outgoing Digvijay Singh Cabinet D P Dhritlahare, who rebelled against the party and has filed his nomination as an independent from Maro constituency of Durg district following denial of party ticket, is also in pursuit of a hat-trick.

Two BJP legislators in the outgoing state legislative assembly Ganeshram Bhagat (Bagicha) and Mr Vikram Bhagat (Jashpur) have also scored a poll hat-trick earlier and are once again in the fray.

Chhattisgarh region, which is all set to become a new state in the near future, constitutes 90 assembly segments of Madhya Pradesh Vidhan Sabha. (UNI)

CBI court extends remand of Laloo and Mishra

PATNA, Nov 13: CBI designated court today extended by another two weeks judicial remand of former Bihar Chief Ministers Laloo Prasad Yadav and Jagannath Mishra in a conspiracy angle case of the multicrore fodder scam.

Special CBI judge S K Lal asked Beur jail authorities to produce Rashtriya Janata Dal (RJD) president Yadav and Bihar Jan Congress chief patron Mishra before his court on November 27 for routine attendance in the case.

However, the two leaders were not produced before the court today on account of illness.

Jail authorities informed the court that Yadav and Mishra were ill and doctors attending them at the sub-jail at BMP guest house, where they are lodged in judicial custody, had advised them bed rest.

While Yadav was reported to be suffering from backache and muscular pain, Mishra was down with fever and stomach problems.

Lal also extended till November 27 judicial remand of former Bihar Ministers Vidya Sagar Nishad, C P Verma and RJD MLA R K Rana.

Meanwhile, Yadav and Mishra today filed special leave Petitions (SLP) in Supreme Court seeking bail in fodder scam conspiracy cases and challenging a Patna High Court order rejecting their bail plea.

A three-judge bench of Supreme Court comprising Chief Justice A S Anand, Justice V N Khare and Justice M Srinivasan fixed November 2o for hearing of the SLP filed by Mishra. Yadav’s SLP, his counsel BB Singh said, may be tagged along with Mishra’s petition for hearing on the same day.

Nishad, Verma and Rana were produced before the CBI designated court today following production of warrants against them in the case.

The case (RC 64 (A)/96) relates to fraudulent withdrawals of more than Rs 97 lakh from Deoghar treasury by the State Animal Husbandry Department officials through forged and fake bills.

The Special Court had after rejecting their prayers for regular bail on October 30 remanded them to judicial custody till today.

Patna High Court had on Tuesday rejected petitions against special court order denying bail to Yadav, Mishra and others in the case. (PTI)

Cong fields more Backwards, SC/ST candidates than BJP

BHOPAL, Nov 13: The ruling Congress has fielded more backwards, minorities and scheduled castes candidates for the November 25 Assembly elections in Madhya Pradesh compared to its arch rival, the Bharatiya Janata Party.

As per the statistics provided by the two parties, the Congress has fielded 79 candidates belonging to the backward communities as against 65 of the BJP. While ten candidates belong to the minority community in the Congress list, the BJP has only one.

Similarly, the number of scheduled tribes candidates nominated by the Congress is 79 as against 77 of the BJP.

The Congress has also fielded five Scheduled Tribes and two Scheduled Castes candidates for the general seats.

As far as the representation of Muslims are concerned, there had been continious decline since 1956-57 when a maximum of ten were elected. There was no Muslim in the outgoing Assembly (1993-98). This time, the BJP has fielded just one candidate, Mr Moinuddin Ansari for the Burhanpur seat, while the Congress has put up six. As far as the representation of women are concerned, neither the Congress nor the BJP have given adequate representation. They form less than ten per cent of the total number of candidates.

The BJP has fielded 29 women candidates, including 13 belonging to Scheduled Tribes and five backwards community.

The Congress, contesting 318 seats had given nominations to 26 women candidates. Among them, ten belong to scheduled tribes, eight in the general category and four each to Scheduled Castes and backward communities.

The BJP has entered the election fray with as many as 142 new faces after denying the ticket to several sitting legislators. As per the figure available with the party sources, only 95 MLAs out of 111 had been renominated. Among the aspirants are the 178 candidates who had contested the 1993 elections.

The BJP has allowed use of its symbol by Mr Sunil Ram Teke of the Republican Party, who is contesting on the BJP ticket from Dongargarh seat in Rajnandgaon district.

Similarly, the Congress party has, under an agreement, left one seat for the Republican Party of India (Khokhar). (UNI)

Addressing an election rally here, she termed the BJP-led Government as one formed by "power hungry middlemen" and held it responsible for the various maladies afflicting the nation such as price rise and deteriorating law and order.

The BJP-led Governments at the Centre and the states had failed in fulfilling its moral responsibility of attending to the people’s problems and needs, especially providing them with essential commodities.

She also squarely blamed the BJP Government for the Mutardoil adulteration episode saying, its failure in taking proper action against the culprits had ruined the livelihood of mustard oil dealers.

Gandhi accused the Rajasthan Government of supporting the Central Government decision hiking the price of the urea instead of taking up the farmers cause.

The Central Government which had allowed export of onion was now importing the same at higher prices, she charged.

Referring to the law and order situation in Rajasthan, she said atrocities on women and crimes in general were on the increase and asked the people to vote for Congress to ensure a better life and usher in all round development.

Linking the eroding purchasing power of the common people due to the policies of BJP Governments, Gandhi said the party had proved itself to be totally devoid of sensitivity to people’s hardships.

She said it was an example of the inability of the BJP-led coalition Government that it could take no effective action in the face of a major problem arising from adulteration of mustard oil which had claimed several human lives.

Gandhi blamed the Rajasthan Government for the mounting unemployment and said this was a direct result of the Government placing a ban on recruitment in jobs both in Government service and public sector units.

The Congress president charged that during the eight-year rule of BJP in Rajasthan, all steps for development taken by the previous Congress Governments had been reversed in all sectors.

She also criticised the Rajasthan Government for what she called its refusal to provide necessary powers to panchayat and municipal bodies as envisaged in the Constitution Amendment Act.

She said that only Congress would be able to provide a stable Government and put the state back on the road to prosperity. (PTI)

Laloo, Mishra seeks bail in fodder scam cases

NEW DELHI, Nov 13: Former Bihar Chief Ministers Laloo Prasad Yadav and Jagannath Mishra today filed Special Leave Petitions (SLP) in the Supreme Court seeking bail in the Rs 950 crore fodder scam conspiracy cases while challenging the Patna High Court order rejecting their bail plea.

A three-judge bench comprising Chief Justice A S Anand, Justice V N Khare and Justice M Srinivasan fixed November 20 for hearing of the SLP filed by Mishra after the same was mentioned before it by counsel A M Khanwilkar.

Counsel for Yadav, B B Singh, mentioned that the Rashtriya Janata Dal President has also filed an SLP today and the same may be taged long with Mishra’s petition for hearing on November 20.

The bench advised the counsel to bring the same to the notice of the registry for necessary action.

Mishra, in his SLP, said he was granted bail by the Supreme Court in a fodder scam conspiracy angle case on October 13, 1997. He alleged that CBI had arrested him again in another conspiracy case where the charges and the material relied against him were same as the previous case.

Yadav in his SLP termed the CBI action of arresting him again as politically motivated while Mishra has pleaded for grant of bail on medical grounds as well. (PTI)

Dr Mishra’s bail petition in SC

NEW DELHI, Nov 13: The Supreme Court today fixed November 20 for hearing a petition moved by former Bihar Chief Minister Jagannath Mishra seeking bail in the multi-crore rupee fodder scam case.

Dr Mishra is currently lodged in a Patna jail. The petition by special leave was directed against a Patna High Court order rejecting his bail plea.

The hearing was fixed by a three-judge bench comprising Chief Justice Dr A S Anand, Mr Justice V N Khare and Mr Justice M Srinivasan on a request made by Dr Mishra’s counsel Ajay Khanwilkar.

Meanwhile, the court directed Rashtriya Janata Dal president Laloo Prasad Yadav’s counsel B B Singh to inform the Registry when he sought to move a similar petition from his client.(UNI)

Shekhwat, Mathur, Deopura in fray

JAIPUR, Nov 13: Rajasthan Chief Minister Bhairon Singh Shekhawat and two of his predecessors—Shiv Charan Mathur and Heera Lal Deopura—are among the 1,439 contestants trying their electoral luck in the November 25 Assembly election.

While Mr Shekhawat is seeking re-election from bali Assembly constituency in Pali district, Mr Mathur, who has held the top post twice earlier, has been fielded by the Congress from the Mandalgarh Assembly constituency in Bhilwara district.

Mr Deopura, who was in office for just two weeks, is contesting the Kumbhalgarh Assembly seat in Udaipur district as the Congress nominee.

Mr Mathur is seeking his fifth term in the Assembly after a gap of eight years. He is pitted against sitting BJP legislator Badri Prasad and three others.

He was elected to the Assembly for the first time in 1972 and again in 1980 and 1990 and held the office of Chief Minister twice between 1981 and 1990. He resigned from the Assembly in 1991 on being elected to the LoK Sabha from Bhilwara parliamentary constituency, for a second term, on the Congress ticket.

Mr Mathur was elected to the lower house for the first time through a by-election in 1962. He lost the 1996 Lok Sabha elections and did not take part in the 1998 Lok Sabha polls. Mr Deopura will take on sitting BJP legislator Surendra Singh Rathore, his brother-in-law Rameshwar Lal Asawa (Ind) and two others for the Kumbhalgarh Assembly seat for his sixth entry to the State Assembly.

He had won his first Assembly elections way back in 1967 from the same constituency and secured his second successive term in 1972. After suffering a defeat in 1977, he won again in 1980.

Since then, he had scored a hattrick but in the last Assembly election in 1993 he was defeated by the BJP nominee.

Mr Deopura was the Chief Minister for two weeks in 1985 when the then Chief Minister Shiv Charan Mathur resigned in the wake of the killing of legislator Man Singh (Deeg) in a police firing. (UNI)

Rabri asks police to check violence

PATNA, Nov 13: Bihar Chief Minister Rabri Devi today directed the State Police to make all-out efforts to check violence in the State.

Reviewing the law and order situation arising out of the latest carnage at Rampur village in Jehanabad district which claimed seven lives, the Chief Minister told a high-level meeting at the Secretariat that police were free to take any step to prevent the recurrence of such incidents.

Apart from investigating suspects, the authorities were directed to take all precautionary measures that could instill confidence in the public. The leaders of these left and right extremist groups should be arrested and their designs nipped in the bud, she told the meeting.

The meeting was attended, among others, by the Chief Secretary, Home Commissioner Raj Kumar Singh and Director General of Police K A Jacob.

The officials informed the Chief Minister of the various measures being taken to contain extremist violence in general and the action taken following the Rampur carnage.

Two suspects belonging to the People’s War Group (PWG) were arrested and eighteen others picked up for interrogation in the wake of the Rampur episode in which the PWG extremists raided the house of Ranbir Sena sympathisers and shot dead seven people two others.

The administration has reportedly taken all steps to prevent recurrence of such massacres. The announcement of Ranbir Sena to avenge the killings has kept the police on maximum alert. (UNI)

NEW DELHI, Nov 13: Delhi High Court today allowed the Central Government to appoint an independent person with experience in the field of arts and culture to head the physical verification committee, formed to verify the valuable articles and objects of the National Museum, and directed the committee to complete its job expeditiously.

Directing the Government to appoint the chairperson from among the names suggested by it without any further delay, a division bench comprising Acting Chief Justice Y K Sabharwal and Justice K S Gupta asked the committee to start its functioning immediately and let the court know within four months about the latest progress in the verification process.

The Bench ordered the committee, which, as per the decision of the Centre, would start its work immediately, to place its progress report in a sealed cover by February 28.

After taking cognisance of the affidavit filed by Mr Avinash Chander Uppal, Under Secretary in the Department of Culture of the Ministry of Human Resource Development, and recording the statements of standing counsel for Central Government Maninder Singh, the court fixed the case for further hearing on March 8.

The Centre, in the affidavit, intimated to the court that it was considering the names of Prof. B N Goswami, Miss Mira Seth, Mr Bhaskar Ghose and Mr M Vardarajan — all experts in the field of arts and culture — for chairpersonship of the committee and a decision would be taken once any of them express their consent.

The directions came during the hearing of a public interest petition filed by the National Archives and Museum Employees Union through its general secretary R S Atal which had levelled serious allegations of huge financial bungling and dereliction in the working of the National Museum.

The committee has been directed to complete its job in one year, the Central Government standing counsel submitted.

The court rejected the prayer of petitioner’s counsel R P Gupta for appointment of a judicial officer as the head of the committee saying that it was not required at this stage.

Mr Maninder Singh stated that there was no need for appointing a judicial officer as the head of the committee as whatever 25 per cent of scrutiny was carried till now had not revealed anything earthshaking.

The affidavit, filed in pursuance of the court’s direction on the last date of hearing, stated that the Department of Expenditure, Ministry of Finance has passed orders with regard to the terms of appointment of the expert committee constituted for conducting the verification of the art objects of the National Museum.

It said the decision of the Department of Expenditure was received by the HRD Ministry on November 5 and the sanction order with regard to their terms was issued by the Department of Culture on November 6.

The Government said that the appointment of a new chairperson was necessitated following the resignation of Prof. M N Deshpande from the committee. Though efforts were made to pursuade him to rejoin he expressed his inability to do so on account of failing health, it added.

Besides the chairperson, the Government named another six persons to work as members in the committee.

While Prof. B N Goswami is the professor emeritus in the Department of Art of the Punjab University, Ms Mira Seth is a retired IAS officer and former member of the Planning Commission who did her Ph. D in Art history and has authored several art publications.

Mr Ghose was former Secretary (Culture) and Mr M Vardarajan has been a former member in the Minority Commission besides being the Culture Secretary.

The court’s direction was given in presence of the Director General of National Museum, who was asked on October 28 to be personally present today.

The court had, on that date, directed the HRD ministry to recommend names for appointment to the post of chairperson.(UNI)

NEW DELHI, Nov 13: India has always been a status quo society unable to adapt itself to changes, chairman of National Human Rights Commission (NHRC) Justice M N Venkatachaliah said here today.

The world would undergo a drastic change in the next ten years with effect far more than that has come during the entire history of humanity, and India should prepare itself to meet the challnge, Former Chief Justice of India said inaugurating a seminar on human rights organised to mark the golden jubilee year of ‘UN Declaration of Human Rights’.

Whether we like it or not, changes would come. Globalisation is no longer a matter of choice, it is inevitable, he said pointing at the incredible effects the speculators of international market would have on country’s socio-economic foundation.

Underlining that India still has to exploit its human resource potentials, he said without effective empowerment of women, education of girl child and proper care of mother-child health, the country could not adapt to these forthcoming changes.

Our mindset should be changed, he said, adding, however, this realisation is slowly dawning. There is at least an awareness today that things cannot go on as they are.

Safe motherhood and aggressive literacy campaign among women, particularly from deprived sections, should be taken up on priority basis, he said. (PTI)

NEW DELHI, Nov 13: Delhi High Court today summoned the Chief Wildlife Officer to explain his position on allegations of permitting a person to keep certain articles in his residence in violation of the Wildlife (Protection) Act.

A division bench comprising acting Chief Justice Y K Sabharwal and Justice K S Gupta directed the Chief Wildlife Officer to be present in the court on the next date of hearing on February 15 alongwith all records related to the case.

The officer allegedly permitted the person to keep the articles without being convinced that the articles were required for bonafide personal use of the person as per Section 49(C) of the Wildlife (Protection) Act, 1972.

The Judges observed, "prima facie it appears that neither an application was made by the propritor of M/S Art India that he deserves to retain the articles for bonafide personal use, nor Chief Wildlife Warden formed an opinion that articles were required for bonafide personal use of the petitioner."

The summons were issued on a public interest petition filed by Wildlife Protection Society of India through its counsel Raj Panjwani seeking proper maintainability of the provisions of the act.

Mr Panjwani submitted that as per the act, the Chief Wildlife Officer has to first form an opinion that the person may be allowed to keep the articles and then intimate his opinion to the Central Government for implementation, but this practice was not followed in the present case.

The officer directly permitted the petitioner to keep the articles, Mr Panjwani submitted adding that the Centre wrote a letter to the officer asking him to reply as to why he had sent the application without forming an opinion.

Counsel for Delhi Government Anil Grover admitted this fact and sought an adjournment to look into circulars, if any, regarding the provisions of the act. (UNI)

Sahib goes on offensive against Samata

NEW DELHI, Nov 13: Former Delhi Chief Minister Sahib Singh today claimed that the killing of Samata Party candidate Ved Singh was the result of "inter-gang rivalry" and criticised the Samata for giving a "political colour" to the incident.

The Samata Party had unncessarily dragged the BJP’s name in the shooting of Ved Singh, a rebel BJP member who was contesting for the Nangloi Jat Delhi Assembly seat on a Samata ticket, Mr Sahib Singh told.

Mr Ved Singh was shot dead in Mundka village in Nangloi Jat constituency on Tuesday night while he was canvassing for support in the area.

The former Chief Minister, who had declared that he would go off food till the police achieved a breakthrough in its investigations, today converted his fast into a relay hunger strike alongwith his supporters, including Delhi Transport Minister Devender Singh.

Declaring that he was "satisfied" with the police investigations, Mr Sahib Singh said that he was hopeful that the culprits would be arrested by tomorrow. However, he and his supporters would continue their relay hunger strike to keep the pressure on police to speedily investigate the matter, he added.

Mr Devender Singh, who is the BJP candidate from Nangloi Jat, said the episode would not have any bearing on his poll prospects. "When the truth comes out, our opponents would only be disappointed," he added. (UNI)
