in murder case acquitted JAMMU, Dec. 25 A Division Bench the State High Court comprising Chief Justice, Mr Bhawani Singh and Mr Justice Arun Kumar Goel has acquitted Bansi, Co-accused involved in Kashmir Singh murder case. In the Acquittal Judgement written by Chief Justice Mr Bhawani Singh it was observed that accused Bansi has filed appeal praying he may also be given the benefit of Judgement whereby Court acquitted Puran Singh and Sagar Singh who were also accused in the same case and convicted and sentenced by the Ist Addl. Sessions Judge, Jammu on July 31, 1992 for the offences U/S 302,/34, 323 RPC read with Section 4/27 Arms Act. He further stated that he could not file appeal as the other two accused since have been accquitted. Mrs Surinder Kour, Advocate appearing for Bansi Singh Co-accused contends that in the main judgement this Court had considered the whole matter comprehensively petitioner Bansi being Co-accused has also been discussed in the Judgement in the light of evidence of prosecution which is directed against all the accused in this case. She placed a Judgement of Supreme Court Jaipal and others. The D B further observed that having considered the case file, particularly the judgement of Jan. 28, 1998 we are of the opinion that while dealing with the appeal we have exhaustively turned to the prosecution evidence in the case. It has been found sloppy, discereptent contradictory and un-dependable, some of the witnesses have turned hostile while others have not supported the prosecution case. There are some who have made improvements in their version, what to talk of independent witnesses, who have not at all come up with a version consistent with the prosecution case, the out come of our discussion and appreciation of the prosecution evidence in the case has been that the prosecution case has remained completely, unsubstantiated consequently, the accused have been acquitted on this evidence like other accused, no case against Bansi Singh is made out.'' The Judgement of Apex Court in Jai Pal's case is applicable to this case. Therefore, Bansi Singh is also acquitted of the charge against him, Judgement of Sessions Judge is also set aside and confirmation reference is rejected. In case the accused is in Jail he be set free forthwith, the court added. |

dismissed JAMMU, Dec. 25 : Mr Justice O P Sharma of the State High Court has dismissed a writ petition filed by inhabitants of Bahu Fort seeking removal encroachment from the Graveyard measuring 8 kanals 15 Marlas comprising Khasra No. 9, Khata No. 169 in Bahu Fort with the directions the petitioner at liberty to approach Administrator Auqaf to seek execution of the eviction orders passed by him. The petition filed through Advocate Anil Sethi on behalf of inhabitants of Bahu Fort. In the petition it was alleged that the Grave yard has been occupied by some persons but neither the Administrator Auqaf nor the eviction authorities constituted under Wakf Act are initiating action to get the land vacated. The petitioner has placed on record. Copies of the orders passed by the petitioner has placed on record. Copies of the orders passed by the eviction authorities which shows that Administrator Auqaf had initiated action for removal of the encroachment. In one of the case order has been passed against Sadiq Hussain Driver on Jan. 15, 1991 another order dated Jan. 14, 1991 has been passed against Iqbal Ahmed Katib, by another order of Jan. 12, 1991 encroachment made by Shafiq Ahmed has been directed to be removed. Similarly by order Jan. 11, 1991 the eviction authorities directed removal of encroachment made by Ramzan Driver and order passed on Jan 9, 1991 has been directed Farid Hussain who has made encroachment and order of Jan. 10, 1991 is against one Mohd. Sadiq. So neither the Administrator Auqaf nor the eviction authorities can be accused of in action Judge held that they have taken and passed order. The question of implementation of these orders with however a different matter. But instead of approaching this Court, the petitioner authorities to get these orders executed in accordance with the provisions of Wakfs Act Judge added. |

to establish Building Centres JAMMU, Dec 25: The Government have decided to establish one Building Centres in each district of the State to introduce and popularise low cost building technology among the people. This was disclosed by the Commissioner/Secretary to the Government, Housing and Urban Development while Mr Pankaj Jain addressing gathering after inaugurating an impressive 3 day Build Mat Expo-98, an exhibition of building material here this evening. Mr Jain said that these building centres shall act as technology transfer centres in the field of housing and building development and will disseminate information on cost effective and environment friendly technology in urban and rural areas. Introduction of cheaper alternate technology was imperative to cope with the ever increasing cost of building material. In addition, the building centres would help impart training programmes for skill upgradation for masons, artisans, carpenters and other building work force, he added and said that the Government have also appointed Town Planners at district level which will go a long way in solving the problem of proper planning in small and medium towns of the State adding that prospective short term and long term town planning was necessary to check migration of population from rural areas to capital cities which put avoidable pressure on available civic services. While appreciating the effort of the Indian Institute of Architects Jammu Centre for organising a building material exhibition on a large scale at Asia Hotel, Mr Jain called for collective efforts of architects and planners to find ways and means for developing cheaper alternate building technologies and material to cope with increasing construction cost. Underlining the importance of proper Architecture in cities and towns, Mr Jain said architecture has to look into the maximum and proper usage of little space available in our cities, the proper usage of floor area, outside and inside architects and decor and proper environment and ecological planning and the landscaping of buildings whether for private or Government use. Similarly, Architect has to ensure optimum utilisation of land so that its full cost is recovered. At the same time, we should dove-tail various schemes like Swaran Jyanti Rozgar Scheme, IDMT and IDSMT Schemes under urban development to get optimum benefit out of these. Mr Jain hoped that the exhibition would help the people to plan building construction programmes more precisely by gathering first hand information regarding various building materials available in Jammu as well as outside the State. The Chairman of the Indian Institute of Architects, Jammu centre, Mr A K Wadhera in his welcome address said that the main objective of organising such exhibition was to keep the people abreast with the latest innovations in building techniques and material used in other developed areas of the country and to provide all relevant information pertaining to Architectural habitat and environmental issues. About 31 stalls have been set up in the exhibition by different agencies and architecture firms across the country including stalls from Delhi, Bombay, Hyderabad and Chandigarh where latest building material have been put on display. The main attractions of the exhibition were cement bonded particle board, a good wood substitute free from hazards of chemicals, KITEC composite pipes, an alternative of copper and G-I plumbing system and SIMCRYL PVC glazing and roofing sheets. These building material are said to be stronger, lighter with longer life and high chemical resistant. The Institute will also organise a seminar on Architecture and construction at the same venue tomorrow where exhaustive analysis would be made on cost effective housing material. |
