Appointment of senior stenographer quashed

JAMMU, Dec 8: Mr Justice O P Sharma of the State High Court Jammu Wing has quashed the promotion of one Abdul Majid Malik Senior Assistant who was promoted to the post of Senior Stenographer (PA to Director) and directed the, Director State Motor Garages and others to fill up the vacancies either by direct recruitment or by promotion, provided all those eligible possess the qualification required for ths post are given the opportunity to compete with each other.

While allowing the petition, Mr Justice Sharma observed that the petitioners are Head Assistants of the Directorate of State Motor Garages and challanged the order dated 22-7-1995 issued by the Director State Motor Garages in which Abdul Majid Malik has been promoted to the post of Senior Scale Stenographer from the post of Senior Assistant. Senior Advocate S S Lehar alongwith Advocate C S Azad appearing for the petitioners argued that the order has been passed in a most arbitrary manner because the then Director State Motor Garages who was about to demit office on supernation by the end of July, 1995.

It is however unfortunate that petitioners Jagan Nath and Suraj Parkash have retired during the pendency of the writ petition and consequently have post any opportunity to compete for the spot with other eligible candidates. However, the other two petitioners Tilk Raj and Sardari Lal are still available and in case the respondents decide to fill up the vacancies from in service candidates, though it will be quite unusual in the absence of Recruitment Rules prescribing qualification and eligibility. However the post can be offered to the inservice candidates after prescribing the minimum qualification and by offering opportunity to every persons possessing such eligibility and holding such test as may be prescribed to select the post’’.

Mr Justice O P Sharma further observed that it may be pointed out that the then Director State Motor Garages, Mr Riaz Ahmed Rather did hurry by convening the meeting of Department Promotion Committee of which he was the Chairman only to see that decks are cleared for appointment of Abdul Majid Malik before his retirement. It is an un-usual act where the Abdul Majid Malik was cleared for promotion in July 1995 which the post has to become available by the end of August, 1995. Inference in such a case is clear that the then Director wanted to conter undue benefit upon the Abdul Majid Malik and did succeeded in it because of the delay involved in disposal of the petition, Judge added.

Acquittal appeal in murder case admitted

JAMMU, Dec 8: A Division Bench of Jammu Kashmir High Court of Jammu wing comprising Chief Justice Mr Bhawani Singh and Mr Justice Arun Kumar Goel has admitted appeal filed by State of J&K against the judgement passed by Sessions Judge Rajouri on August, 19, 1998 whereby the Sessions Judge Lal S/o Bhim Sen R/o village Kalideh tehsil Sunderbani who had committed the murder of his real brother Ashok Kumar.

While admitting the acquittal appeal filed through Additional Advocate General, Mr Amrish Kapoor the Division Bench issued bailable warrants against accused Chaman Lal in the sum of Rs 5000 with one surety in the like amount the accused undertaking to appear in this court as and when called. The court also call for the record from the trial court.

According to the prosecution story during that intervening night 23/24 February 1997 Ashok Kumar deceased was beated by his brother Chaman Lal accused and was brought in the notice of police station Sunderbani. It was alleged in the prosecution story that deceased developed relations with his maternal Aunt which resulted in the barat of deceased returned home without bride. It is alleged that accused being a real brother of deceased felt disgraced which resulted the beating of the deceased. On 25/26 February the accused confined the deceased in a room of his house and tied him with rope and beaten him severely due to the beating deceased become unconscious and admitted in the PGI Chandigarh where he expired on March 2, 1997.

The police after investigating the case presented the challan in the court, the court after recording the statement of witnesses acquitted the accused Chaman Lal from the charges.

The state filed appeal against the acquittal judgement and prayed for setting aside the judgement passed the Sessions Judge Rajouri.

NGOs must play their vital role: Governor

JAMMU, Dec 8: The Governor, Mr Girish Chander Saxena has called upon the Non-Governmental Organisations (NGOs) to make sustained efforts for removing hardships and sufferings of the people and also the victims of militancy in Jammu and Kashmir.

Speaking at a seminar on the role of NGOs in prevailing scenario in the State, organised by the Confederation of Voluntary, Social and Charitable organisations at Abhinav Theatre here today, the Governor said that NGOs being non-profitable and non-partisan institutions have a significant role in the overall development process.

While the Government, he stated was making all possible efforts in ameliorating the condition of disadvantaged and handicapped sections of the society, these organisations have to complement and supplement the endeavours of the Government. He said that NGOs owed major responsibility for spreading the message of communal amity and presenting a caring and compassionate society through their dedicated work at the grassroots level.

Referring to the prevailing security scenario in the State, the Governor said that the overall situation has shown tremendous improvement and now it is heading towards greater normalcy. He observed that the NGOs should devote themselves to the cause of mitigating the sufferings of the victims of militancy. The situation has thrown open new opportunities and challenges for NGOs in the areas of their re-settlement and rehabilitation, he observed.

Mr Saxena said the NGOs should have full and firm commitment to the noble cause of serving the suffering humanity. They should show visible results and win the confidence of the people, he said and added that mere mushrooming of these organisations will be not of much utility.

Dr R R Khajuria,president, J&K Confederation of Voluntary, Social and Charitable organisation, in his welcome address highlighted the role of NGOs in the State. He demanded that grant-in-aid to the NGOs should be enhanced and provided expeditously, two directorates of Social Welfare for Kashmir and Jammu be set up and land allotted for the Apex organisation.

On the occasion, papers on different themes of social work were read by Mr R K Mujoo, Mr S P Verma, Mr S S Jamwal and Mr Daya Sagar.

The Governor presented mememtoes for dedicated social service to Mr J S Chouhan, Mr Ashok Sharma, Mubarak Gul, Sheikh Abdul Rehman, Maj Gen(retd) G S Jamwal, Mr Gulchain Singh Charak, Dr Ashwani Jojra, Mr Shoukat Javed.

In the second session, the Minister of State for Food and Supplies, Mr Ajay Sadhotra underlined the need for giving momentum to the spirit of voluntary service for the poor and helpless persons in the society.

Mr Sadhotra asked the volunteers to create awareness among the people particularly in the rural areas about the social works and various welfare schemes being implemented in the State.

The Minister referred to a number of schemes launched for the welfare of the people, particularly living below the poverty line. Earlier, the Chairman, Legislative Council, Mr H S Bali expressed his appreciation for the work being done by various voluntary organisations in the State. He asked the people to extend their full co-operation to the NGOs in their objective of social service for the poor and helpless persons..

A large number of office-bearers of various NGOs from all over the State,leading social workers, prominent citizens were present.

LEH, Dec. 8: In order to resolve the installation work of additional Diesel Generating Set at Choglamsar, a meeting was held here today under the chairmanship of the Additional Deputy Commissioner, Leh Mr. T. Angchok.

As per a release, besides the leaders of the Non-gazetted Electrical Union, Leh, the chairman Citizen Council, Mr Rigzen Kalon, the Presidents of Ladakh Buddhist Association, Ladakh Muslim Association, Anjuman Imamia, Christian Association Leh, President's of district Congress Committee (I), National Conference Leh, Nambardar Association, and President, All Non-Gazetted Electrical Employees Union, Leh, Mr T Angchok and Secretary, Mr Abdul Sattar were among the participants.

The leaders of the various political and religious organisation while participating in the meeting appealed to the Electrical Employees Union Leh to resume the installation work of the additional 1MW D.G. Set at Choglamsar in the largest interest of the people. They also assured their full cooperation with the union for their legitimate demands particularly grade disparity of the employees with their counterpart of District Kargil. They also assured to join with them in support to their demands, in case their genuine demands are not resolved by the concerned authorities.

The meeting also stressed to resolve the administrative problems of the Electrical employees at the district level authority.

Considering the appeal of the local leaders, the Electrical Union headed by its President, Mr T. Angchok, unanimously agreed for installation of the DG set at Choglamsar to ensure uninterrupted power supply to the public in view of approaching Lossar and Ramzan month.

The meeting also appealed to the public to utilize the power judiciously keeping in view the limited availability of power generation from DG set.

The meeting also asked the Govt to consider the genuine demands of the Employees Union at the earliest.

JURSA felicitates scholars
SLET within two months: VC

JAMMU, Dec 8: The State Level Eligibility Test (SLET) for College and University teachers will be completed within two month in ten disciplines in Jammu.

This was stated by the Vice-Chancellor of Jammu University, Prof R R Sharma, while speaking in a felicitation function organised by the Jammu University Research Scholars Association to honour the JU scholars, who have excelled at national and international level.

Prof Sharma, who was chief guest in the function felt sorry for not conducting the eligibility test on earlier announced date on November 22 and assured the scholars that this time there will be no change in the date which will be announced shortly. He also assured the scholars of all possible help in enhancing the scholarship, which he said has been delayed due to financial crunch.

In total, 27 scholars who have passed their National Eligibility Test (NET), Research Associates (RA) and Senior Research Fellowship (SRF) from CSIR since 1996 were awarded with a trophy and certificate of merit by the chief guest.

Earlier, a colourful cultural programme by the scholars and students marked the felicitation function with a tradition beginning with ‘Sarswati Vandana’ by Rupinder Kaur a student of History. It was followed by ghazals, skits, and dances on the tunes of popular songs.

Chamber submits memo to PM

JAMMU, Dec 8: The Chamber of Commerce and Industry submitted a memorandum to the Prime Minister Mr Atal Behari Vajpayee on his visit to Jammu and Kashmir.

As per a release the Chamber while welcoming the Prime Minister Mr Atal Behari Vajpayee on his maiden visit to Jammu and Kashmir for taking keen interest for the development of Jammu and Kashmir State, urged him to resolve the genuine demands of the people of the State.

The Chamber demanded proper development of railways infrastructure as during the past 10 years of insurgency, the pilgrimage to Mata Vaishnodevi has proved to be a boon for Jammu region. The Chamber reiterated its demand of introduction of a daily train between Jammu and Hardwar to facilitate movement of pilgrims between Jammu and Hardwar, both being major centres of religious importance.

The Chamber pleaded further that in view of increasing rush of Mata Vaishno Devi pilgrims which is touching nearly 50 lakh pilgrims annually, coupled with improvement in militancy related incidents, the State expects heavy rush of pilgrims and tourists.

The Chamber pleaded that since the State was expecting heavy rush of pilgrims, both national and international, the Government should not only convert the single line railway track between Jammu and Jallandhar into double track but also to introduce Shatabdi Express between Jammu and Delhi to cater to the ever increasing rush of tourists, pilgrims and the people of the State.

The Chamber has also pleaded for development of tourist infrastructure to boost the economy of the State and help the people of the State to generate enough employment for themselves.

The Chamber held that it has already submitted memoranda to Union Tourism Minister Mr Madan Lal Khorana and others for ensuring Airbus service between Delhi and Jammu which the Chamber said would certainly boost pilgrim traffic to Jammu airport.

The Chamber memorandum also pleaded for development and improvement of industry which stands marred by lack of support by State and Central Government. The Chamber stressed for opening up of a Rail Coach factory and an Ordinance Factory in the region so that enough of employment was generated in this region of the state.

The Chamber has also pleaded for waiver of expenditure incurred by the State Government for curbing militancy and other security related expenditures as the militancy in the State was a matter to be tackled at the national level.

The Chamber sought personal intervention of the Prime Minister to ensure implementation of the demands projected by the Chamber for improvement of the the economy of the State.

Dialogue only solution to present imbroglio: Mufti

JAMMU, Dec 8: Reiterating his stand that initiation of dialogue is the only solution to the present imbroglio in Kashmir, the former Home Minister and MP, Mr Mufti Mohammed Syed has said that suppressing the people with gun will not solve any problem.

Addressing the public meetings at Kalakote he alleged the National Conference (NC) Government was ruling the state on gun point which will aggravate the situation further.

The Congress leader said the people of the state need a healing touch as they have gone through lot of violence and persecution during these years. But instead of taking steps in this direction the present Government is doing quite opposite which will prove counter productive in the long run, he warned.

Mr Mufti Syed said he has already taken up this issue with the Central Government.

Coming down heavily on the NC Ministers and MLAs, he alleged that they never ventured out of their palatial houses to see the plight of the people, particularly those living in the rural areas. He said these people are without the basic amenities of life. The callousness of the Government is the basic reason that the people want a change as they are fed up with the present set up.

Charging the NC ministers for misuse of Government money, he said the funds earmarked for various works were not being utilised properly.

He said the developmental works are at stand still and the NC rulers were befooling the people on false slogans.

He said instead of misleading the people on catchy slogans of autonomy the NC Government should solve the problems of unemployment, pay attention towards the development and work for restoration of peace and normalcy.

Mr Syed also lashed out at Union Government said the packages announced by the previous governments for the people have proved false.

He said that Central Government should attend to the ground problems in the state and involve all the national parties for ever lasting peace.

He said J&K is a national problem and the cooperation of all national parties should be sought in working out a policy which is acceptable to all.

Speaking on the occasion Ch Mohammed Aslam Pradesh Congress chief urged the Congress workers to be prepared for united struggle against the National Conference Government.

He alleged that Dr Abdullah has lost grip on the state, administration and the people.

The Congress leaders were on three days tour of the Rajouri district. They were also accompanied by former MP Mr Mangat Ram Sharma, Balvan Singh, Talib Hussain, Ashok Sharma and Balbir Singh MLAs.

JAMMU, Dec 8: Various organisations have endorsed their full support to the employees protest rally and dharna on December 12, the call for which has been given by Employees Joint Action Committee (EJAC).

In a statement issued here today, Jammu and Kashmir Government Employees and Workers Federation, urged the Government to concede the demands projected by the EJAC.

Messrs Lekh Raj Khajuria Federation president and its secretary general Chaman Lal Bamzi have appealed its all affiliated units to participate in the EJAC programme on December 12.

Jammu and Kashmir Medical Employees Federation has also decided to participate in the EJAC programme.

In a meeting here today held under the chairmanship of its secretary general, Mr Chaman Lal Bamzi, the Federation decided to take active part in the programme on December 12 for making it a success.

The meeting among others was attended by Messrs Susheel Sudan, president JKPA, K S Chowan, Vinod Kumar, Ajeet Kumar, Gurcharan Singh and others.

AKPSC holds rally

JAMMU, Dec 8: All Kashmiri Pandit Solidarity Conference (AKPSC) held a rally at Purkhoo Camp, Phase Four today in which the National Conference (NC) Government was taken to task for its failure in solving the problems of the displaced KPs.

Addressing the demonstrators Mr O N Trisal, president of the AKPSC alleged that no worth while measures were taken so far for the rehabilitation of the displaced people by the Government.

He also hailed the statement of British MP Lord Avebury for snubbing the Hurriyat leaders and showing concern for the plight of KPs.

The rally was also addressed by Mr P N Tengloo, general secretary AKPSC. He urged the camp dwellers to maintain unity in their rank and file for facing the future challenges.

Mr H L Bindroo another general secretary of the organisation while stressing on unity between camp and non camp migrants asked them to learn a lesson from their past bickerings and come on a single platform.

Messrs R K Mahanoori and Bushan Lal Raina also addressed the rally.

Rich tributes paid to Dr Ambedkar by BSP leaders

JAMMU, Dec 8: Bahujan Samaj Party (BSP) Samba unit observed December 6, the birth anniversary of Dr B R Ambedkar as "Sad Bhavna Divas".

A function in this connection was held at Samba Rest House in which a large number of Party workers participated, a BSP release issued here today said.

Rich tributes were paid to Dr Ambedkar by the speakers on the occasion. Those who paid homage to the late leader include Messrs Som Nath, MLA, Samba, Master Puran Chand, Block president, Nanak Singh, City president, Ramesh Kumar, block president Ghagwal, Kunj Lal, Puran Chand, Bhagu Ram and Parshotam Singh.

The speakers urged the people to follow the path shown by the late leader.

In his speech Mr Som Nath urged the people to be united against the communal forces and strengthen the Party so that the dreams of Baba Sahib Ambedkar is realised.

He also criticised the National Conference Government headed by Dr Abdullah. He alleged the Government has failed on all fronts. He said the developmental works are at stand still as the funds are being misused by the ruling Party.

He said the people face the scarcity of drinking water and shortage of electricity in the rural areas.

He alleged that the studies of the students have adversly been affected in backward areas as the schools are closed for a long time.

AIKHF flays Central, state Govts

JAMMU, Dec 8: All India Kashmiri Hindu Forum (AIKHF) has charged the Central and state governments for their failure in solving the problems of the displaced people.

The Forum chairman, Mr Rattan Lal Bhan while addressing the Forum meet here on Monday alleged that no concrete steps were taken for looking into the problems of rehabilitation, unemployment and other issues of the community during last nine years of its migration.

He said the birth rate has considerably declined in the exiled community while the death rate has increased during these years.

He said the KPs are the original inhabitants of the Valley but due to the failure of the secular forces in the country the community was forced to flee from the Valley in 1989 on gun point.

He said by building community centres or replicas of holy places in Jammu and outside the state will in no way help in cultural rejuvenation and stressed for introspection among the community members.

On the occasion ladies wing of the Forum was also announced by the state president, Mr Brij Nath Hali. Mrs Shama Ji was elected as its patron while Mrs Raj Kumari was elected president.

Miss Meenakshi and Dr Jyoti Dhar were elected as vice president and general secretary respectively.

Telecom employees demand probe into official’s death

JAMMU, Dec 8: Co-ordination Committee of Telecom Employees of J&K Circle has expressed its profound grief and sorrow over the demise of Mr Madan Lal, S I who died in mysterious circumstances few days back.

As per a release, the Coordination Committee has decided to hold gate meeting and demonstrations daily till a thorough probe is not initiated in the matter.

It also demanded suspension of two officers whose names were brought in the notice of administration.
