4 yrs imprisonment in attempt to murder case

JAMMU, Oct 19: Principal Sessions Judge Udhampur, A K Koul today awarded four years imprisonment and fine of Rs 8000 to Vinod Kumar alias Dalu, son of Sansar Chand of Chak Road, Udhampur, who was facing trial in attempt to murder case for the last 7 years.
“The wounds found on the victim and the weapon used by accused to cause such wounds do show that accused meant to kill the victim and he did everything which he could  in the given circumstances to kill the victim”, the Court said.
“But it was his good luck and grace of the God which infused life in the victim and he could survive. So, the act of the accused squarely falls within the ambit of Section 307 RPC. He has also breached Section 4 of the Arms Act and has kept in his possession a ‘kirch’ having a blade of the length 16 inches and width 1.5 inch”, the court said, adding “apart from attempt to murder accused has committed an offence under Section 4/25 Arms Act”.
Accordingly, Court convicted the accused and awarded him imprisonment for three years and fine of Rs 5000 under Section 307 RPC. He was also sentenced to imprisonment for one year and fine of Rs 3000 for commission of offence under Section 4/25 Arms Act. In case of default in payment of fine, he will undergo further imprisonment for two months.
