3 yrs RI to Pak national

JAMMU, Feb 28: Additional Sessions Judge Jammu Shahzad Azeem today awarded three years RI and fine of Rs 10000 to Abdul Qayoom of Sialkot, Pakistan, who had illegally entered Indian territory from Khour area in September last year.
After hearing APP Abdul Hafiz appearing for the State whereas Advocate Lokesh Sharma appearing for the accused, Additional Sessions Judge observed, “there is nothing on record or any material collected by investigating officer, which would show that accused entered into territory of India with intention to commit some offence, therefore, lenient view is required to be taken”.
Accordingly, court was convicted for commission of offence punishable under Section 14 A (b) of Foreigners Act 1946 and awarded imprisonment for a period of 2 years and a fine of Rs 10,000. “In default of payment of fine, accused shall further serve imprisonment for a period of one month”, the court said.
The accused was also awarded imprisonment for a period of 1 year for the commission of offence punishable under Section 3/12 (c) of the Passport Act. “All the sentences of imprisonment shall run concurrently”, the court said.
