JSM leader demands equal
treatment to Jammu region
Excelsior Correspondent
JAMMU,
Oct 17:
Prof Virinder Gupta, co-chairman, Jammu State
Morcha, has stated that fractured mandate of the
people has clearly reflected the people of Jammu
and Ladakh have entirely different political
aspirations than those of Valley.
In a statement
here Prof Gupta said the people of Jammu and
Ladakh regions have rejected the hegemony of
Kashmiri leadership and voted for parties which
promised to fulfil their regional aspirations and
give them an honourable place in the State
political set up.
He said people of
Leh under the banner of Ladakh Union Territory
Front projected their unity as a result two of
their members were got elected to Assembly
unopposed, which amply proves that
re-organization of the State has over-whelming
and unassailable support among the masses.
Prof Gupta stated
further that in Jammu region, for the first time,
people having affiliations with various political
groups fought election on the issue of Statehood
to Jammu. Several legislators like four of
Panthers party, Ashwani Sharma from JSM, Babu
Singh, a member of Jammu Statehood Front, Dr
Manohar Lal Sharma from Billawar, Puran Singh
from Darhal and Ajaz Ahmed of Gool Arnas are
committed to end discrimination against Jammu
region.
He said as a first
step towards ending discrimination with Jammu
region, a fair delimitation of Assembly
constituencies to bring both regions at par would
be a welcome step. He added that since Jammu
region has more voters as compared to those of
Kashmir valley, Jammu region should have more
seats than Kashmir valley
The JSM leader
said the tug of war on the issue of Chief
Ministership with PDP having only 16 MLAs in the
87 member Assembly claiming the CM post proves
beyond doubt that Kashmir leadership does not
want to give up its hegemony and treat Jammu as
equal partner in the J&K Political set up.

Complaint
on accidental claim dismissed
Divisional Forum slaps penalty
Excelsior Correspondent
JAMMU,
Oct 17:
The Divisional Forum Jammu, constituted under the
J&K Consumer Protection Act has dismissed a
complaint regarding accidental insurance and
imposed a penalty on the complainant payable to
the OP as costs for frivolous litigation.
Mr D K Kapoor,
president and Mrs J K Gandotra and Mrs Ambika
Khajuria, members of the Forum while issuing
orders said that a bare reading of the
cross-examination of the witnesses leads us to
believe that the claim put forth by these
witnesses/ complainant is only false and
frivolous which is not maintainable. Due their
act the OP has been dragged to unnecessary
litigation and while dismissing the complaint we
hold that the complainant shall make a payment of
Rs 5000 to the OP as costs for frivolous
litigation forced on the OP.
This amount shall
be payable by the complainant to the OP, either
through cheque or draft or deposit with the Nazir
of this forum within six weeks from the date of
this order, failing which the Forum may invoke
the provisions of section 21 of CPA 1987 on the
application made by the OP in this behalf.
The
complainants bus No. JK02B/ 3415 which was
under insurance cover with the OP from March 99
to March 2000, allegedly met with an accident on
8-8-99, due to which it suffered heavy loss and
since the OP did not accept the case and hence
the claim of the complainant filed a case. The
party was demanding payment of Rs 1.38 lakh
including Rs 1.18 lakh spent on repair and Rs
10,000 as compensation for mental agony and Rs
1000 as cost of litigation.
It was alleged by
the OP surveyor that there was no evidence of
accident on the spot shown and case seemed to be
fabricated. It was again claimed that only Rs 16,
750 was spent by the party on the repair in the
yard where bus was shown under repair. The Forum
held that the cross examination of both brothers
Sanjeev Bhasin and Satish Bhasin shows that
neither of them is aware of the accident or
repair having been conducted or the amount spent.
They have shifted burden on each other during
questions. It was observed that the OP has been
dragged to a litigation and the complaint was
dismissed, imposing penalty on the complainant.

Refugee
leaders plea to Govt
Excelsior Correspondent
JAMMU,
Oct 17:
The chairman of Refugee Welfare and Educational
Society, Sunderbani, Dr Ram Chander Sharma has
condemned the Indian Governments decision
to withdraw Army from International Border.
In a statement
here Dr Sharma said the decision contradicts
Indias claim that PoK is an integral part
of India. He said over 10 lakh refugees from Pok
living in Jammu and Kashmir and other parts of
India have expressed concern over decision of the
Pakistan Government to raise the height of Mangla
Dam in Mirpur area of PoK and allotment of land
in PoK to army officers and feudal lords.
He said the
Government of India is back-tracking on its
policy of hot pursuit and taking back Pak held
areas of Jammu and Kashmir. He added that 1972
Shimla Agreement was a conspiracy against the
interests and aspirations of PoK refugees to
return to their homes and hearths in PoK. Their
long pending demands have not been looked into
and instead Indian Government was towing the
American line of appeasing military Government of
Pakistan.
Dr Sharma said all
the sacrifices made by the martyrs shall go in
vain if India did not change its flawed Kashmir
policy of appeasement to a section of community
in J&K and having a soft corner towards
Pakistan.
He has appealed to
all the nationalist forces to pressurize Indian
Government to change its J&K policy and take
bull by horns.
