Justice Jhanji for check on
corrupt practices in courts

JAMMU,
Nov 19:
The senior most judge of the State High Court Mr
Justice V K Jhanji has assured the Bar
Association Jammu for shifting the subordinate
courts from Mandi Mubarak complex to newly
constructed court complex at Janipur.
While speaking to
Bar members last evening, Justice Jhanji said
that the State High Court has already issued
direction on a writ petition filed by the Bar
Association Jammu that State would complete the
subordinate courts complex at Janipur
before December 31, 2002 and the members now
should follow the matter.
The Bar president,
Mr A V Gupta while welcoming Mr Justice Jhanji in
the Bar room said that the calendar prepared by
the High Court for the vacation was not suitable
to the advocates because in the Educational
Institutions, the vacations were start to from
December 25 and the vacations start in the State
High Court from the month of January. He also
requested for the vacation of Diwali and Bhayya
Dooj. Justice Jhanji assured the Bar members to
look into the matter.
The members lodged
a complaint against the corruption among the
ministerial staff of the Subordinate courts and
sought strict vigilance on their activities.
Justice Jhanji
taking cognigence of the alleged corrupt
practices in the courts, asked Bar president to
constitute a committee of five advocates who will
sit with the Principal District Sessions Judge
once a month and take action against the alleged
corrupt employees on the basis of complaints.
Justice Jhanji who
was on two day inspection tour of subordinate
courts was invited by the Jammu Bar Association
for apprising him of the problems of the
advocates.

employees to get Oct-Nov salary before Idd:

JAMMU,
Nov 19: The Jammu and Kashmir State Road
Transport Corporation (J&K SRTC) employees
would be paid their salary for the month of
October and November 2002 before Idd.
This assurance was
given by the Deputy Chief Minister, Pt Mangat Ram
Sharma to a deputation of the Corporation
employees and workers federation that called on
him here last evening.
The deputation led
by the Chairman of the Federation, Sheikh
Mohammed Amin, Patron Haji Bashir Ahmed and
President of the Truck Fleet, Noor Mohammad Bhat
presented a memorandum listing demands of the
employees of the Corporation. The demands include
conversion of SRTC into Government Transport
Undertaking, special package for the Corporation,
implementation of Sub-Committee report for
placement of non-pensionary employees in the
permanent category, extension of time bound
promotion, release of COLA and 5th Pay Commission
arrears, release of budgetary support to the
Corporation, detachment of civil hired transport,
re-installation of tyre retreating plant and
re-commissioning of body building fabrication.
The Deputy Chief
Minister assured the delegation that all their
demands would be discussed at the joint meeting
of the concerned officers and the members of the
federation. He said that every effort would be
made to bring out the Corporation out of red.
Referring to the
demand for grant of COLA, Mr. Sharma said that he
would inquire as to why it has not been paid to
the employees though the same has already been
sanctioned by the Government. He said the
decision of payment of COLA would also be taken
up shortly and it would be ensured that the same
is paid before the Idd.
The Deputy Chief
Minister asked the employees to re-double their
efforts and work with added zeal and devotion and
derive maximum benefits from the existing fleet
to enable the Corporation to meet its expenses
from its own resources. He called for providing
better transport facilities to the commuters and
laid stress on bringing transparency and
accountability at all levels to make the
Corporation viable and profitable.

PAS organises workshop on AIDS
awareness

JAMMU,
Nov 19:
To educate youth about the HIV, AIDS and its
sociological as well as psychological impacts,
Public Awareness Society (PAS), an NGO, in
collaboration with NSS, organised a two day
workshop at SPMR College of Commerce.
The awareness and
training workshop is being attended by 110
participants representing various institutions of
Jammu province including Kathua, Doda, Udhampur
and Rajouri districts.
Delivering the
inaugural address, Dr M A Wani, Director AIDS
Control Society J&K, threw light on the most
fatal disease prevailing in the world and assured
all possible assistance, help and guidance for
the conduct of such workshops on AIDS.
He disclosed that
in Jammu and Kashmir State, 0.81 per cent
population is feared HIV infested even as the
AIDS Control Society has launched several
programmes to aware masses about the deadly
disease.
Dr Wani further
informed that HIV virus has claimed 21 million
human lives in last two decades while 6.5 million
deaths due to AIDS were reported in last year. In
India, he added, Maharashtra, Tamil Nadu, Andhra
Pradesh, Karnataka and Mizoram have the maximum
number of AIDS patients.
Prof Reeta Munshi,
Principal of SPMR College of Commerce, in her
presidential address, appreciated the PAS
activists and NSS volunteers for organising such
a workshop and hoped a positive impact of such
programmes.
District
Co-ordinator of Nehru Yuva Kendra Mr Nisar Ahmed
Bhat, who was guest of honour, interacted with
the participants and assured all possible help to
the NGO for social programmes.
In the second
session, Dr Kum Kum Sharma, HoD Blood Bank in GMC
and Dr Amar Singh, who were resource persons,
delivered lecture on AIDS control and need of
blood grouping.
Earlier, in the
morning, the College Principal inaugurated the
workshop by lighting traditional lamp. Prof Ajit
Angral, NSS PO for the Commerce College, welcomed
the participants and guests.

general secretary PAS and Harminder Pal Singh
Bindra, publicity secretary, highlighted the aims
and objectives of the NGO and presented vote of

deputation meets CM

Nov 19: Jammu University Research Scholar
Associations (JURSA) deputation today met Chief
Minister and pro-Chancellor Jammu University,
Mufti Mohd Sayeed and apprised him of the
problems being faced by Research Scholars and
students.
Analyzing various
problems of the Research Scholars, Mr Kishor
Sharma, president JURSA drew the attention of
Chief Minister towards various irregularities and
harassment being meted to various teachers in
different private Degree and BEd Colleges in the
State which needed to be checked.
The Association
demanded enhancement of scholarship from rupees
1200 to Rs 5,000 each, priority to local
deserving candidates in the selection process,
early processing of advertisements in higher
education for filling the posts of lecturers,
construction of two more hostels for boys and
girls etc.
The JURSA release
issued here, further said that there is
non-pursuance of UGC guidelines in various
private degree and BEd colleges. It said that
local deserving candidates having State Subject
of J&K be given priorities in the selection
process in both Universities of the State. It
further demanded that Research Scholars be given
representation in the Legislative Council.

lakh pilgrims join annual congregation of Baba
Bhoto

JAMMU,
Nov 19: Nearly six lakh pilgrims from all
over the country joined the 2-day annual
congregation of Baba Bhoto, a religious saint of
Mahajan Baradari, at Gohmanasa here today. The
annual congregation coincides with the birth
anniversary of Guru Nanak Dev Ji.
The Deputy Chief
Minister, Mr Mangat Ram Sharma was the chief
guest at the function.
Speaking on the
occasion, Mr. Sharma threw light on the life of
Baba Ji and asked the gathering to follow the
path shown by the saint Baba.
Referring to the
demands put forth by the Management of the All
India Baba Bhoto Committee, Mr Sharma said that
the road connecting Asthapan would be widened and
metalled and the adjacent land measuring 2 kanals
would be transferred to the Asthapan. To check
the soil erosion, a bund would be constructed on
the nallah in the area..
On this occasion,
the management had opened free langer for the
devotees. The management is also running a
charitable hospital where poor and needy are
provided treatment free of cost.
A large number of
devotees had come from Delhi, Agra, Mumbai,
Meerut, Punjab, Himachal Pradesh, besides Jammu
and Kashmir.

Decrease
in militant violence continues in Kashmir
SRINAGAR,
Nov 19:
Decrease in the militant violence in Jammu and
Kashmir continues even as the coalition
Government headed by Mufti Mohammad Sayeed has
released more than 15 senior separatist leaders
since it assumed office on November 2.
The release of
senior separatist leaders, including Jammu and
Kashmir Liberation Front (JKLF) chief Mohammad
Yaseen Malik, is being seen a step forward to
normalise the situation.
The separatist
alliance All Party Hurriyat Conference (APHC),
while welcoming the release, said permanent peace
was not possible in the sub-continent till the
core Kashmir issue was resolved.
50 people,
including 30 militants and 13 civilians, were
killed during the first fortnight of the Mufti
Government a sharp decrease from 90 people,
including 27 civilians, killed during the
previous fortnight.
According to
official figures available here, barring November
2, when Mr Sayeed took the oath of office, the
Kashmir Valley witnessed a less violence in the
last fortnigh compared to that during the
previous period.
On the first day
of the Government, militants killed three police
personnel, a defeated Congress candidate and two
others while security forces gunned down seven
ultras across the Valley.
Militants also
fired a couple of rifle grenades towards the
Chief Ministers Nowgam residence causing
injuries to a guard on the same day.
However, since
then the graph of militant violence came down and
the next 14 days saw the killing of three
security personnel. 23 militants were also killed
during the same period.
In the first week
of the new Government, three militant leaders
including Showkat Bakshi and Nazir Ahmad Sheikh
(JKLF) and Mohmmad Ayub Dar (Hizbul Mujahideen),
were released after 12 years of imprisonment.
This was followed
by the release of about 12 other leaders,
including JKLF chief Malik, Mushtaq Ahmad Waza
(Peoples League), Abdul Aziz Dar alias General
Moosa of Hizbul Mujahideen and Sheikh Abdul
Rashid ( Hurriyat spokesman). A spokesman of the
Hurriyat Conference, expressing satisfaction over
the release of detenues, described it "good
for the freedom struggle".
However, he
alleged that some leaders whose release was
announced by the Government were still in
different detention centres.
Other separatist
organisations, however, said that release of
detained leaders would not help to restore
permanent peace in the State.
They said that
for a lasting peace in the sub-continent, Kashmir
the issue had to be resolved once and for all in
accordance with the wishes of the people of Jammu
and Kashmir.
Meanwhile, the
security forces suspended all routine cordon and
search operations across the Valley in view of
the holy month of Ramzan.
However,
operations on specific information continued,
officials told UNI.
They said the
routine operations were stopped as a goodwill
gesture to the people of the Valley because of
Ramzan.
However, in case
any specific information is recieved that
militants are going to strike at a particular
place, not a moment will be wasted in launching
an offensive against them, they added.
"We will not
compromise if the security of the people is
involved," they said.
The army, on
November six, had announced a relaxation on
restriction of movement of the people across the
Valley during Ramzan.
The spokesman said
the decision has been taken in order to
facilitate offering of prayers, especially at
night and early morning, without any hinderance
during the month.
However, one could
see Border Security Force (BSF) personnel
frisking pedestrians and searching passenger and
other vehicles in the city, including Natipora
Nowgam.
The Hurriyat
spokesman, quoting deputations from different
areas of the Valley, also alleged that security
forces have not stopped harassing people. (UNI)

The new building complex of Raina Higher
Secondary School, Chak Seri in Bhalwal was
inaugurated by Director School Education Jammu,
Mr M S Khan in an impressive function organised
by the management and staff of the school today.
According to a
release, the Director while congratulating the
management of the school also appreciated the
performance of the students. He said that a good
building has been raised by the management in
this rural block of Bhalwal and the people should

Hiranagar
MLA gets degree college for constituency

JAMMU,
Nov 19:
Veteran Congress (I) leader and MLA from
Hiranagar Mr Girdhari Lal said today that the
much pending demand of Hiranagar people for a
degree college has been conceded by the State
Government.
Mr Girdhari Lal
told EXCELSIOR that he raised the demand for
degree college in the District Development Board
(DDB) meeting of Kathua and it was principally
agreed by the Government. Besides, he said, the
Government has also agreed to open ten plus two
schools at Koota and Chandma and upgradation of
girls high school Hiranagar to higher secondary
level. A high school for boys between Mawa and
Sarthian and another high school at Jatwal were
also okayed by the Government.
The MLA said he
sought four tube wells for his constituency. The
Government has immediately sanctioned one tube
well at Suba Chak and promised others shortly at
Phalapur, Arjun Thuthe, Tandwal and Budhu Chak.
The Government has also ensured that problems in
Ravi Tawi lift irrigation scheme will be solved
immediately so that kandi area get sufficient
water for irrigation and other purposes. Three
tributaries have also been sanctioned from Ravi
canal for Chan Khatrean, Kattal and Rasaath.
Mr Girdhari Lal
said the Government has also decided to repair
old Ujh canal at war footing. Eighty hand pumps
have also been approved for Hiranagar, he added.
He said the Government has assured that the
relief for the border migrants, which was due to
end by November end, will continue. He said the
Congress (I) was committed to its election
manifesto of providing 10 marlas plot each to the
border migrants in the safer areas.
The Hiranagar
legislator demanded that a Radiologist should be
posted immediately in the sub district hospital
in Hiranagar so that the patients are benefitted
from X-Ray and Ultra Sound facilities. He also
demanded residential quarters for the doctors. He
said the Ayurvedic dispensary at Saisma should be
converted into Allopathic. He also sought health
sub centres for Chan Roarian and Gurha Mundia.
Mr Girdhari Lal
demanded upgradation of Hiranagar Notified Area
Committee (NAC) to Town Area Committee (TAC) and
upgradation of Rajbagh and Bhagwal to NAC. He
said the inter-state buses should stop at
Hiranagar Morh.
The MLA Hiranagar
said water, power and road in the entire
Hiranagar constituency would be his main focus.
Each house would be connected with roads and each
and every village would be electrified. Capacity
of the transformers will also be increased, he
added. He said he would strive for handing over
Sanji Morh-Kot Punnu road and Old Samba-Kathua
road to GREF. He also demanded construction of
bund over Ujh and the bridges over Bhag-Kot and
Madoon nullah.
In reply to a
question, Mr Girdhari Lal hoped that the Congress
(I) will keep in view that he represented the
Chamaar biradri among the Scheduled Castes. The
party high command, he hoped, would keep this in
view during the Ministry formation. The lone SC
Minister in the present cabinet Mr Mula Ram
belonged to Megh biradri.
It may be recalled
that Mr Girdhari Lal had won Hiranagar seat with
second highest margin of 18,472 votes in the
State. He was only 200 votes short from the
highest margin of 18,600 votes, recorded by his
party colleague Ghulam Mohd Saroori in Inderwal.
Mr Lal won Hiranagar seat for the Congress after
two decades. In between, the seat had been
represented by the BJP.

Party to move SC if State Subject
Commission not wound up

JAMMU,
Nov 19:
Terming State Subject Enquiry Commission a
constitutional mechanism to create political
conflict and communal hatred in the State,
Chairman of Jammu and Kashmir National Panthers
Party (JKNPP) Prof Bhim Singh has threatened to
move Supreme Court if the Commission was not
wound up without any delay.
The Commission has
no legal locus standi to challenge the
citizenship status of the permanent residents of
the State by making the mockery of rule of law,
said Prof Singh while addressing media conference
here today.
"After the
introduction of the democratic Constitution in
1957 and with no state subject law in the State
the very creation of Commission is illegal and
unconstitutional", Chairman of JKNPP said.
He argued that since the Commission was
unconstitutional and had no legality, it cannot
decide on the citizenship of the bonafide
residents of the J&K State.
He regretted that
the Commission had been allowed to challenge the
dignity and identity of the most respected
citizens on the non-existent complaints having no
names or identity of the complainants.
This is the climax
of Commissions performance, Prof Singh
remarked, saying that it has not spared even a
sitting Governor Babu Parmanand and a Union
Minister Prof Chaman Lal Gupta. He added that
dashing off a notice to them is absolutely
a reckless, unacceptable and malafide act
of the Commission.
"Taking
cognizance without a valid evidence or even a
name of the complainant is itself a criminal act
and if the Commission is not disbanded with a
heavy penalty on its members for deliberately
damaging the credibility of the men in the
highest office in utter violation of law, the
authorities concerned will have to face music in
the Supreme Court", he warned.
He also criticised
the appointment of new Vice-Chancellor of Jammu
University.

arrested for looting vehiclists

UDHAMPUR,
Nov 19: Police today arrested five persons
for forcibly taking money from the vehiclists by
lying naka near Kishenpur Manwal.
The Maruti van
bearing registration number JK14-3893 which was
being used by them in the purpose was also seized
by the police. When the raid was conducted by the
police the said five persons were taking money
from a car driver. An amount to the tune of Rs
5000 was recovered from their possession.
The arrested
persons have been identified as Susheel Khajuria,
son of Fakir Chand of Shastri Nagar, Udhampur,
Rakesh Kumar, son of Sansar Chand, Gautam, son of
Surya Parkash, Vijay Jamwal, son of Prem Singh
and Sunil Sharma, son of Ishwar Dass, all the
residents of Udhampur.
The sixth accused
Arjun Singh was absconding when reports last came
in.

World
heritage week celebrated at Manwal

Nov 19:
The world heritage week was organised by
Archaeological survey of India (ASI) at Manwal in
district Udhampur today.
According to a
release, the programme was organised in the
premises of Devi Bhagwati temple Manwal. A well
organised colourful cultural programme was
presented by the school children of Dream India
Public Higher Secondary School Manwal and
Brahamrishi Vidhyapeeth.
On this occasion
besides cultural items, a drawing competition was
also held. Mr A N Badyal, Ist Class Magistrate
Majalta while Mr PBS Senger, Superintending
Archaeologist (ASI) presided over the function.
In drawing
contest, the first prize went to Bhajan Lal, a
student of 9th class of Dream India Public High
School, second position went to Anil Bhardwaj of
class 6th of the same school while prize was
jointly shared by Sapna Jagotra of 6th class and
Lakhan Singh of 3rd class.
In fency dress
competition Ist prize went to the students of
Dream India school. The participants
includedTarun, Renu, Rubi, Pooja, Shamli,
Jugal, Parveen, Kamlesh, Arun, Meena, Veena and
Nisha.
The ASI official
while addressing the children on the occasion,
spoke on the importance of World Heritage Week.
He also briefed the students about the
functioning of department of ASI. He asked the
people to cooperate with the department for the
better preservation and maintenance of the
monuments. Ms Raj Rani functioned as stage

Sharma, president, O P Khajuria, general
secretary and Jagmohan Sadhotra, working
president of JKTUC who spoke said that birth
anniversary of Mrs Indira Gandhi is being
observed as "National Integration Day".
A large number of workers participated in the
function and paid rich tributes to Mrs Gandhi.
Other prominent
persons who attended the function included Ch
Mohd Iqbal, Rattan Lal Manhas, Vinay Gupta, Mrs
Lalita Sharma, Shivdev Singh, Sardari Lal Dubey,
Deepak Sharma, Vijay Sharma, R D Verma, Tara
Chand Bhagat, Kasturi Lal Gupta and Ram Swaroop
Sharma, Bimal Khajuria. J&K PCC workers Union
also attended the function, notable among them
being Puran Chand, Ravinder Gandotra, Rattan Lal,
Sat Paul Gandhotra and others.

Pro-Pak
guides are trusted carriers
Motivators in J&K are the
highet paid

A sensational
discovery: The highest paid among the
pro-Pakistan elements and activists in Jammu and
Kashmir, in recent years, have been the
motivators, who toured urban localities and rural
areas, advising youth to cross over to Pakistan
occupied Kashmir (PoK) for armed training. And
sometimes they coerced the youth, too.
The discovery is
from Mr Birbal Nath, well-known security
specialist and former Director-General of Border
Security Force and Advisor (Law & Order) in
the Union Ministry of Home Affairs. Mr Birbal
Nath, who has had access to highly classified
information, has let it be known that
intelligence agencies have been able to identify
them and the wealth earned by them is
"amazing".
Next come the
guides, who, according to Mr Birbal Nath, lead
the motivated youth to gallies and passes
avoiding security pickets. Guides, he says, are
"trusted carriers of the revolt".
Mr Birbal
Naths book titled Kashmir: The
Nuclear Flashpoint has noted that next to
guides come activists whose task is to mobilise
public opinion against the action by the security
personnel in Kashmir. Former chief of the BSF
does not subscribe to the theory that Pakistani
money started flowing into Kashmir only recently.
He proclaims:
"The fact is that from its very inception
Pakistan had tried to suborn loyalty through
money". His finding: Families of prominent
leaders, barring a couple of exceptions,
benefited from Pakistani largesse. Then Pakistan
started pumping money into front organisations.
The most successful use of Pakistan money was to
fundamentalise and forge unity among Muslim
organisations.
Finding number
two: The money which flowed into Kashmir from the
Gulf countries, was by way of over-invoicing of
exports and was essentially Pakistans
money. The organisation and financing of various
terrorist outfits in the Valley had been overseen
by Pak Inter-Services Intelligence (ISI) during
the time of Lt-Gen. Hamid Gul. The organisation
showed ingenuity and expertise of uncommon order.
Hamid Gul was as big a fundamentalist as Gen.
Zia-ul-Haq.
Mr Birbal Nath
also disagrees with the general feeling that
militancy started in 1990. On the basis of
evidence, he says that the situation acquired
pro-militancy dimension after the communal riots
engulfed Kashmirs Anantnag district in
February 1986. These riots, he says, catapulted
Dr Qazi Nissar Ahmed to the sentre-stage.
Hence, his finding
number three: Fundamentalisation under Dr Qazi
Nissar got equipped with a formal structure. This
individual provided the ideologically fertile
ground from which armed militancy was to sprout.
Going by the data
available with the former chief of the BSF, the
success of the clandestine operation, started in
1979 by President Zia-ul-Haq,has come late; it
took 8 years to take off. Finding number four:
President Zia succeeded in reaching the rural
areas through the network of madrassas and the
womenfolk, who in Kashmir were always in the
forefront; they were aroused with fundamentalist
fervour to frentic pitch.
Mr Birbal Nath is
not kind to Indias rulers, who, he
insists,"cannot be exonerated of the charge
of creating conditions where insidious
fundamentalist insurgency would thrive. Thus all
the more reason for his finding number five: New
Delhi neglected the health of Kashmiri
bureaucracy and ruling elite , thereby enabling
the fundamentalist outfits not only to create
insurgency-like conditions but to infiltrate
every instrument of governance whose duty it was
to report on the new fundamentalist virus and
suggest remedies.
"The stark
reality of non-governance in Jammu and
Kashmir", Mr Birbal Nath recalls," was
well known to Pakistan as well as the collusive
character of the administrative machinery".
Arguing that a wise strategy is not to allow
bands of rebels coalesec, he has observed:
"When terrorist groups amalgamate en masse,
insurrection rises. Whereas terrorism has nowhere
succeeded, whether in Palestine, Ireland or
Punjab but insurrections during the World War II
helped the Allies to succeed".
And his
pertinent question: Shall India learn from
history or merely allow it to be repeated? While
stating that in India every party decided to ride
the communal tiger to seize power or
maintain itself on the top, Mr Birbal Nath posed:
"Did they expect Kashmiris to be blind to
this erosion of secular values in the
country"?
Finding number
six: By swamping Kashmir rulers with money, which
was squandered on non-productive projects rather
than alleviating the human misery in the ghettoes
in the downtown Srinagar, India thought it had
done its duty towards Kashmir whereas India
should have acted as a trustee of Kashmiri
culture and Kashmirs welfare. Since India
prides itself as a democracy, it should have
removed all obstacles to the flowering of genuine
democracy in Kashmir.
Finding number
seven: Political opportunism and lack of long
term strategy for development and secularisation
of Jammu and Kashmir have proved fatal....The
common Kashmiri did not see evil in Kashmiri
bureaucrat or elected legislator but by a strange
quirk of logic he held Delhi responsible for all
that was wrong.
Stating that the
present lull in the terrorist campaign in Kashmir
is not due to political reasons but due to
operational constraints, Mr Birbal Nath has
noted: "The main being that Kashmiri youth
is, for the present at least, disillusioned with
Pakistani exploitative tactics. Let us not forget
that Pakistani ISI had yet an inexhaustible
arsenal at their disposal".
On the
Governments efforts to revive political
process in the shape of restoring status quo
ante, Mr Birbal Nath has drawn the conclusion:
"Never will it be status quo ante now in
Kashmir. It is self-defeating to seek status quo:
New Delhi wants to pass the buck to local
satraps".
Yet another
conclusion: Unless Pakistan relents in her
efforts to train and arm insurgents, no orderly
progress in J&K is possible. Conclusion
number three: Seventy-five percent of the
Kashmiri youth who had taken up arms, feeling
frustrated on the failure, are roaming various
cities of India in search of jobs; 20 per cent of
the militant youth feeling frustrated are in
search of employment in Kashmir Valley itself.
Only 5 per cent of those who had taken to arms,
are still working with the Afghan mercenaries.
