Wake up India

Sir,

December 13, people call it 'Black Thursday'. But indeed it is the darkest chapter in the history of terrorism that India has faced in the past two decades. When the American cowboys were attacked they retaliated with bombs and missiles. It gives me shivers thinking what the Americans would have done, had the white house been attached?

I am not sympathising with the Taliab. My sole aim is to draw attention on the point that when the Westerners felt their democracy and freedom was under threat their modus operandi was "First, Retaliate, then provide evidence to the world". When India's centre of democracy is under threat their tone is "First show evidence, then we'll think". I wonder where is the youth of this nation. Is the youth in this country so busy that freedom seems to be a negligible topic? I agree fellow Indians that there may not be enough jobs, food, facilities, but people wake up. This is your country. This is India Bharat, our nation.

It is Indian cultural heritage in which we take pride. It is variety of languages and people that we are proud of. This is my India, your India, our India. It was here that we were born and had the privilege to call it our motherland. Since ancient times, people came to conquer us but we survived though we never learnt from our past history. National reconstruction is not an easy Job. To achieve our goals, we have to make sacrifices. The path will be difficult and impossible but with determination and hard work we will emerge victorious.

Mushrooming Nursing homes

Sir,

This is in reference to the publication is your esteemed paper Daily Excelsior Dated: 25.12.2001, captioned "No Check on Mushrooming Nursing Homes."

Nursing Homes are registered by a board comprising one Dy Director Drug Control Organisation, one Surgeon, one Physician, one anaesthetist headed by a Dy. Director Health Services, Jammu as chairman.

The registration is done by the board only when it is satisfied as regards location, building rooms, ventilation, sanitation and other facilities like requisite staff and medical equipments available.

The list of Registered Nursing Homes is published from time to time for the information of public, so that they avail the facilities of only registered Nursing Homes.

As regards the service charges no rates have been fixed by this office.

The prices of drugs are also not monitored by this office

GP Fund subscribers' grievances-I

Sir,

It is right time for the Director Funds Organisation to stop and take stock of the relevant laws governing the functioning of his organisation than weaving cock and bull stories in a bid to provide a smoke screen to the inefficient, corrupt, lack-lustre and mal-functioning of his organisation which, from all standards when viewed from its functioning as of now, is a total burden on the scarce financial resources of our state. (Refer Director Funds Organisation clarifies -Daily Excelsior January 4).

In the first instance I can safely say that an organisation can in no way claim that it safeguards the state exchequer which in itself is a big drain on the same. The subscriber, insurant is not concerned as to who committed the mistake resulting in his mis-credits, What he is concerned with is that he has paid the money on different counts and it should be paid to him as the laws envisage. The General Provident Fund Rules SVT 1981 (1924 AD), Rule 8(1) (Recast by SRO 385 dated 15.9.1966) says: " Subject to the provisions of this rule, the sum which accumulates to the credit of the subscriber will, when he quits services, becomes his absolute property and will be handed over to him unconditionally on written application from him...."Schedule II inserted by SRO 450 dated 14.11.1966 provides additional strength to this rule. Besides the expansion "absolute property" comes under the provisions of right to property as guaranteed under Article 300-A of the constitution of India. By denying the credits to the subscriber the Director is denying to the subscriber both his legal and constitutional rights.

Rule 8 (ii) of the State Insurance Fund Rules SVT 2004 (1947 AD), issued by the General Department says: "in the event of the insured surviving to the insurance anniversary just preceding the attainment of age 55 the full sum assured shall be paid to the insured. "With regard to the fact that all the insurance premia have been paid by the insurant there can be no other substantial proofs than the rules on the subject. Rule 16 (A) of the above quoted rules says: "If accepted, notice to the employee proposing and to Treasury Officer, for deducting premium from the monthly pay bill:-- If Secretary to Government Finance Department decides to accept the application, he will notify to the employee and the officer who draws the employee's salary, the amount to be deducted from the monthly salary in respect of the premium for the life insurance granted. "The certificate below Rule 17 (A) makes the point sufficiently further clear that all the premia due have been realised from the insurant" I certify that the persons from whom no dedfuction have been made towards insurance premia are those from whom no premia are due."

In the light to the above the making of the Funds Organisation a subscriber/insured run from pillar to post and releasing his maturity value in parts leave no room for one to believe that the Organisation needlessly makes people to suffer in order to justify its existence.

I would , therefore, once again beseech our daring and dynamic Finance Minister to do away with this Organisation and find other methods of maintenance of the accounts of the subscribers/insurants. It shall bring another feather to his cap.

GP Fund subscribers' grievances-II

This has reference to Daily Excelsior of 4th January 2002 captioned funds organisation clarification. Mr. Joseph Dhar, is quite within his rights to speak "Why there are missing credits". His grievance is genuine which may be considered more as a caution to streamline the working than war of attrition.

The credits of the subscribers are not to the expected from any distant or foreign place to make the affair in accessible. These had to come from the sister deptts. who could have been pressed or at best approached to expedite the information. At times personal contacts, meetings could be more useful in mitigating the hardships of the subscribers. This buck passing will not do at all. Rules and Regulations are enacted for the convenience of the public. Besides, there is no rigidity in the separation of powers that could prevent us to come to the expectation of the public.

I had earlier suggested through this very print media to chalk out a calender of returns specifically bringing out "Due to and Due from Statements, schedules" from DDO's office to concerned Treasuries and from Treasury to fund organisation to be watched faithfully followed with monthly reconciliation with two sets of books to avert the chances as missing credits and delay.

Besides I had invited your kind attention to the honest comments of Mr. K K Gupta the then Director Funds Organisation who had lucidly discussed the modus operandi from adjustment of missing credits of subscribers on collateral evidence. This has reference to his No DF/TEch/57 (B) 8895-8910 dated 14-12-1987. This too had not been given any credence resulting in the colossal harassment, humiliation of the subscribers for no fault or reason. This is how we create hurdles, ignore justice, malign the image of machinery.

The Director Funds is suggested to sort out the problem with his counterpart Director Accounts and Treasuries, concerned Do and TOs to put the things on right track.
