Section
3, sub-section (1) of the Jammu & Kashmir
Prevention of Defacement of Property Act, 1985,
provides that whoever defaces any property in
public view by writing or marking with ink,
chalk, paint or any other material, except for
the purpose of indicating the name and address of
the owner or occupier of such property, shall be
punishable with imprisonment for a term which may
extend to three months or with fine which may
extend to one thousand rupees or with both; and
Section 3 (2) further provides that where any
offence committed under subsection (1) is for the
benefit of some other person or a company or
other body corporate or an association of persons
(whether incorporated or not), then such other
person and every President, Chairman, Director,
Partner, Manager, Secretary, Agent or any other
officer or person concerned with the management
thereof, as the case may be, shall unless he
proves that the offence was committed without his
knowledge or consent be deemed to be guilty of
such offence.
Section
4 of the Act provides that an offence punishable
under the Act shall be cognizable.
It
has been noted that unscrupulous elements have
been painting the walls/public places for the
purpose of publicity which causes defacement and
destruction of the cleanliness and gives a dirty
look to the general environs of the city. The
Enforcement Wing of the Jammu Municipality plans
to launch prosecution against such
elements/agencies under the above mentioned Act.
The Enforcement Wing of the Jammu Municipality
takes photographs of such painted advertisements
for the purpose of record/evidence and thereafter
whitewashes these to maintain cleanliness in the
city. Soon, we shall be publishing the names of
such organizations/commercial agencies in the
Newspapers who have been defacing the walls
around the city and giving it a dirty look.
Through
this notice all such organizations/commercial
agencies are informed to remove/erase these
advertisements pertaining to them with in a
period of fifteen days, at their own cost,
failing which action under subsection (2) of
Section 3 of the Act shall be initiated against
them.
As
far as the Cinema Posters are concerned, ten
sites stand already identified with the city and
communicated to the Cinema Owners after holding a
meeting with them in this regard. All the Cinema
owners have agreed that they shall not put up the
cinema posters elsewhere than at the identified
sites. If any cinema poster is found posted at
any other place other than the earmarked sites,
action shall be initiated against the defaulter.
Ours
is a beautiful city. Lets beautify it rather than
deface it.

Timber Sale Notice
It is
hereby notified to all the concerned/public in
general that the open Auction for the sale of
timber (Deodar, Kail, Fire & Chir) stocks
lotted in all the SFC Sales Depots like Bachan,
