Irregularities
in appointments, promotions
Sir,
While the majority
of people in the trouble torn State of Jammu and
Kashmir particularly in Kashmir Valley were
facing numerous hardships and financial
constraints and living in uncertain conditions
due to spurt in militancy, a section of people
and the bureaucracy of the different departments
derived maximum benefits of the surcharged
atmosphere by conferring better position to their
henchmen, placing them against key appointments
by making backdoor appointments of the men of
their choice against available vacancies and by
promotion of their favourties violating all
established norms i.e seniority, merit, good
performance and behavior and alike. Number of
such orders issued by different departments have
been held void by the Hon'ble High Court and
several others are pending the scrutiny of law.
Among these
departments, who resorted to the malpractices of
the type, the Accounts and Treasuries or
ganisation has been much notorious.
Since July 1992,
the Accounts and Treasuries organisation is
making the appointments, promotions of their
favourities on pick and choose basis or have
appointed Junior scale Accounts officers on
promotion disregards of the age-old established
norms of merit, seniority, good performances and
behavior etc. presuming at their own that senior
officers belonging to peaceful or safe zones may
not like to avail of the benefits of the
promotions in the disturbed areas of the valley
or elsewhere in Jammu Division, and even now this
practice is in vogue. Normally the senior
officers ought to have been promoted in routine
and only on their refusal to join against the
higher post, or on their formal consent to forego
the promotion, these posts could be filled up by
the promotion of Junior Officers. A few
prospective officers also challenged the
irregular practice through a SWP in J&K High
Court at Jammu, yet after their promotion the
department again resorted to the practices and is
still in vogue.
The table of such
malpractices or irregular action do not end here.
Even those officers (Junior Accounts Officers)
that were appointed by direct recruitments, and
failed to complete their probation successfully,
having failed to pass SAC part I and SAC part II
examination in terms of rule 24 of J&K
Accounts Service (revised) Rule 1972 were, not
only posted against "duly posts'' contrary
to the provisions of rule 20 of Jammu and Kashmir
Civil Service (Classification Control and Appeal)
rules 1956 but even granted annual increments
beyond the prescribed period of two years in
violation of Rule 25 of J&K Accounts
(Revised) service rules 1972. These officers were
granted non-Functional promotion in the selection
grade and also promoted as senior Accounts
Officers, by regularising the services of these
officers as Accounts Officers in relaxation of
the standing statutory rules and orders vide
Government order No. 218-F of 1998 dated
29.7.1998 ignoring the claim of their seniors who
have already passed the aforesaid examinations
and were eligible for promotions.
There are several
other instances of such nature that will be
highlighted sometime else.
