Govt's silence over SC ruling

Sir,

Apropos editorial titled "Dearness Allowance" which appeared in the Daily Excelsior on 31.1.2001, and in this connection no action has been taken by the Government on Supreme Court Orders delivered in Suraj Prakash's case whereunder a timely compliance of judgement was ordered to be made. The Government though constituted a Committee, the said High Power Committee has not met even once. Obviously for the reason that the officers constituting the committee are of divergent ideologies and are keenly absorbed in their day to day work.

As per the orders dated 17.11.2000 of the Hon'ble J&K High Court passed in SWP No. 676 of 1999 titled Mohan Lal and others V/s State of J&K and others, the high power committee had to work out the promotions made from 1984 to 1995 in all the feeding services of KAS. However it has done nothing despite the fact that the compliance of the orders was to be made by 31.1.2001.

It is all ironical but a common man, however, is certainly helpless before such a mightly armed State.

Sheer exploitation

Sir,

I would like to draw your attention to a news item published in your daily dated 25th January 2001 in box under the heading "N.C. may leave if BJP fails to condemn Bharat Sansad decision: Omar." I usually see the programme Bid Question conducted by Karan Thapper. The last one held on 23rd Jan. night 2001 was also witnessed by me wherein Omar Abdullah State Minister for heavy Industries. Mani Shanker Iyer M P (Congress) and some Rajya Sabha members of the Communist Party, participated. Omar Abdullah who was representing the Govt. of India side replied the question appropriately with confidence which not only satisfied the audience but made the other two participants eat a humble pie. He proved quite match to them who were pretending to be most wise men of the times. I personally felt that Omar Abdullah feared better than even BJP stalwarts who had earlier participated in this programme. The point to write to you is that I felt disappointed to note that instead of reporting the full discussion, only the item which could be exploited was high lighted by media. It proves the points that the press seems interested only in provocating the public sentiments. Had the other points of discussion also been reported, like the one that Mani Shanker Ayer alleged that Kashmir question was inter nationalized by the present Govt. and Kashmir problem was not handled properly. To this Omar Abdullah replied that at initial stage the internationalization of Kashmir question was made by the Congress by referring it the United Nations organization during Pandit Jawahar Lal Nehru's time and mishandling of Kashmir by the Congress rule during last 45 years. This could have give the chance to the reader to judge by himself about Omar Abdullah. For God's sake kindly stop exploiting public any more. Bringing out only negative points tantamounts to exploitation.

Release pension arrears

Sir,

The State Govt. as per Govt. order No. 58-F dt. 5-2-1998 had to release the 5th CPC pay arrears in three equal annual instalments inclusive of house rent from April, 1998, April 1999 and April 2000 in cash. Against it, the State Govt. released one instalment in cash and released 2nd instalment vide Govt. order No. 12-F dt. 2-2-2000 was impounded in the G P Fund account of employees and the 3rd instalment due in April 2000 has not been released so far.

Similarly as per para 2 of Govt. order. No. 127-F of 1998 dt. 16-4-98 the 5th CPC pension, family arrears were payable in the instalments. Although, first instalment of pension, family pension arrears was paid in cash and where arrears were exceeding Rs. 5000/- 50 percent balance arrears was also included and paid in the Ist instalment. As regard balance arrears these were to be paid in 2nd instalment.

The Central Govt. released one percent DA due from 1.1.2000 and 3 percent due from 7/2000 was also released in time. Although all other States of Union of India including Delhi have also released the same to its employees and pensioners/family pensioners but J&K State Govt. have not released not the 2nd instalment due from 7/2000 so far despite repeated requests. Not only this, Central Govt. order No 45/10/98- P & PW (A) dt. 17.12.98 which provides 50 percent pension and 30 percent family pension of the minimum of revised pay scale of the post held by a retiree at the time of retirement, has been made applicable by all others States w.e.f 1.1.1996 but the J&K State is the only State which has not made the ibid scheme/order applicable to the State pensioner, family pensioner despite promises at various occasions and in meeting at Secretariat level.

Such dilly dallying spree in releasing and paying pension dues to the pensioner, family pensioners retiree pre 1.4.1987 and others is an injustice to them particularly during these hard day of economic depression when every well to do is feeling, facing financial striggency.

As regard updating and consolidation of pension of retiree on or after 31-3-85 to 1986 they were paid the only relief provided in para (b) of Govt. order No. 93-F dated 1.4.1998 effective from 1.4.87 as per incomplete ready reckoner. As 10 percent Addl. relief on existing pension and D A subject to minimum of Rs. 50/- and maximum of Rs. 100/- i.e. Rs. 164/- which has not been allowed to them the afore after deducting Rs. 164/- from total relief of Rs. 325/- as provided in para (e) of ibid order the balance of Rs. (325-164) Rs. 161/- was payable to the ibid period retirees by adding the same in their 50 percent pension to be raised on one month average pay emoluments.

Either fix pension at Rs. 636/- on (WEF) 1.8.86 on old slab system to be re-calculated in term of SRO-586 dated 23.10.1979 operative from 1.4.79 to 31.3.87 on the basis of one month average emoluments of Rs. 1446/- accompanied the pension case @ Rs. 701/- or as laid down in para (b) of Govt. order No 93-F dt. 1.4.88 effective from 1.4.87 the pension to be re-calculated at 50 Percent on one month average emoluments as mentioned above. Therefore the pension to be re-calculated correctly in light of sub-paras (C-1) (C-11) and (C-III) of para (C) of the order.

It may be added that the position was brought to the notice of treasury officer Addl. Treasury Old Sectt. Jammu to update the pension consolidated, vide last letter No. 38/PF/98/99 dt. 14.8.2000 but nothing has been done by the dealing Asstt. so far. As the concerned pensioner of the ibid category are in recurring monthly financial loss for non updation of their pension in the above manner therefore the Director Codes J&K Finance Deptt. is requested again in continuation of written request vide No. AJKTA/94/2000 dt. 14.11.2000 to issue necessary instruction to the Treasury office, Addl. Treasury Old Sectt. Jammu to up-date/consolidate the pension correctly without further delay
