Environmental crisis

Sir,

It is in reference with Magsaysay award winner, noted environmentalist from J&K State and a senior Supreme Court Lawyer, Mr. N C Mehta's article "Need to set up Environment Commission in J&K" published in your esteemed Daily dated December 11, 2001.

Mr. Mehta has rightly highlighted the Environmental crisis presently faced by J&K. River Tawi which is the holy source of water for the most of people in Jammu is being polluted at an alarming rate as said by Mr. M C Mehta. Unfortunately, J&K Government has not taken any concrete steps against the plying of old vehicles. The role of NGOs in the preservation of environment suggested by Mr. Mehta could be vital. It is unfortunate that State Pollution Control Board is not dealing purdently with various Environmetal issues faced by our State. I appreciate the view of Mr. Mehta that Environment subject should be introduced in the schools of our state like other States. It will be fruitful to aware our generations about environmental crisis and their remedies. Lastly, I would like to divert the attention of our Government to follow the guideline given by the great Environmentalist from our State Mr. M C Mehta. Otherwise the damages being made to our environment will be out of reach to repair later on.

Only NC demands autonomy

Sir,

This in reference to a letter entitled "Restoration of Autonomy" written by Mr Teja Singh, which appeared in your news paper on 20.12.2001, (Mail Column). The learned author has sought answers of Primary questions formulated by him, from the readers, whether the recommendations of State autonomy Committee as endorsed by a resolution of the State Legislature to Union Government for its acceptance, contravene or are consistent with the provisions of Constitution of India and further, whether Constitutional Relationship of J&K State with Indian Union can be varied or demanded. In response to question first, it is submitted that the State Autonomy Committee, in its III-drafted and self-condradictory report has sought/recommended the omission of Articles 330 to 342, of the Constitution of India as applicable to State of J&K which deal with the Welfare of the Scheduled Castes and Schedule Tribes of the State. The recommendations on page No. 102 and 181 of the report, clearly and unambiguously contravene, and are inconsistent with the provisions of the constitution of India. Moreover, it is to bring in the notice learned author that except SCs and STs all sections of people living in the State were given representation in the Constitution of State Autonomy committee.

So far as second question is concerned, the author is well aware of the Constitutional position that no Law passed by the Parliament is applicable to State of J&K unless, it is approved by the State Legislature. Therefore, all Union Laws extended to State of Jammu and Kashmir from time to time have been approved by the State Legislature and there is no question of their omission or amendment, in any respect under the Indian and the State Constitution. It is the same ruling class which had brought and passed these Union Laws in the State Legislature and now the same ruling Class wants the omission of these beneficial Legislations extended and accepted by the State Legislature. I would further like to inform the author that the demand of the Autonomy is not the demand of the people of three Regions of the State. It is a demand of ruling National Conference only, just to exploit the political and religious sentiments of the people of the State.

Let Pak pay price

Sir,

The softness of Indian State was overwhelmingly on display when a handful of indoctrinated fanatics sneaked into the premises of the Parliament without much difficulty, thereby making mockery of the entire security apparatus. Our leaders derive satisfaction from the fact that similar type of attack had been executed on Pentagon, the power centre of the world's super power. Secondly, it is argued that it is highly difficult to stop suicide bombers as the deterrent of death does not work against them. So, what option remains? The highest democratic institution of the largest democracy is attacked and we are not able to decide how to retaliate. No measure of security, howsover, foolproof is going to be hundred percent perfect. Such types of incidents are bound to happen in future, as long as the supply line is alive. We have been fighting the menace of terrorism for the last about 15 years. We have been claiming success after success, busting terrorist hideouts and recovering large quantities of arms and ammunitions but the menace is becoming deadlier with every passing day.

One and only one reason is that our neighboring country Pakistan is sponsoring terrorism from across the border with impunity. It is a low cost war for them being fought on our territory. Their aim of giving India thousands cuts is being executed without any significant cost to them. Unless and until our neighboring country is made to bear the cost of their mischief, situation is never going to change. Our leaders will have to decide once for all whether Pakistan is make to bear the cost for their misadventures or allow the prevailing situation to continue where our highest democratic institutions also are not safe.
