Apropos 'court
summons Maj Gen G S Jamwal, others' appearing in
the Daily Excelsior dated 17 Dec. 01.
Surprisingly, you have published the press
release given by four directors out of 15
directors of the Board of Directors which include
six directors from the Govt viz director from
NCDC, director planning J&K Govt, MD SIDCO,
Additional Registrar Cooperative Societies, MD
JAKFED and General Manager Super Bazar, without
any basis. Even these directors have not alleged
any allegation in their petition to the Registrar
dated 06 Dec 2001. The directors have only
appealed on an point of law that under the SRO
404 dated 20 Sep 2001 the chairman is not allowed
the second term, but since the Act has been
amended removing this bar, the SRO does not apply
to the new Act as it is inconsistent with the
provisions of the new Act. This point was raised
by these directors with the Returning Officer at
the time of election, but was over-ruled.
Thereafter these very directors elected the
Chairman unanimously, and now they have appealed
against their own unanimous verdict. Since the
appeal is with the court the matter is subjudice.
Incidentally, all
the four directors Major BR Dogra, Major KS
Padwal, Junior Warrant Officer Mohan Singh and
Havildar BS Manhas stated in the Court of
Registrar Cooperatives during the hearing on
18.12.2001 that they had not given this release
to the Press.
There is no other
allegation in the appeal which you have mentioned
to malign the name of a soldier who has dedicated
his life for the welfare of the ex-servicemen.
All the allegations, even statements are false
i.e it is alleged that the factory has incurred
Rs. 6 crores loss in nine years. It is not true,
the Society has actually made a profit in 1998.
The reasons for
the losses are entirely different which were
beyond the control of the Society such as effect
of Earthquake on Kandla Port, hike of import duty
by the Central Govt. by Rs. 6000/- per ton after
we had tendered to the Army and the Price hike of
mustard due to agremore deaths and the levy of
additional toll tax of 4 percent at the entry by
the State Govt thereby causing a loss of Rs. 1.5
crores. All this has been submitted to the Govt
along with the Resolution passed by these very
Directors which shows that all these losses were
beyond the control of the Society which has also
been accepted by the Govt and the NCDC.
All this amounts
to defamation of the Chairman and harming the
business prospects of the Ex-servicemen's Society
which is not only deplorable but shocking.
