Bring barbarians
to book
Sir,
In present day
world order, emphasis is on eradication of
terrorism and upholding human rights and Indian
judiciary has always upheld this new approach in
high esteem, granting human rights jurisprudence
a constitutional status to inculcate a sense of
accountability in public authorities towards
people (even if they are renegades) and
particularly towards the deprived sections of
society, the only aim being to secure a social
order where individuals as well as masses shall
be free from inhuman and barbaric treatment and
even such people those might be indulging in such
activities which can easily be termed as anti
national in any other democratically advanced
country are given a free and fair treatment by
courts in India but the biggest question before
us today is whether such rights are also
available to judges or not.
"Salus Populi
Suprema Lax" (the walfare of people is
supreme law) adequately enunciates the ideals
cherished by judiciary in India and the history
of modern India is proof that justice is
administered lawfully, judicially, without fear
or favour and without being hampered or thwarted.
But the question arises in wake of the recent
killing of a young, dynamic and upright judge in
our state, can it be effective unless respect for
judiciary is fostered and maintained.
The situation and
times through which J&K is passing simply
enhances the importance of administration of
justice, which being a constitutional right and
denial of what (even to militants &
terrorists) is simple violation of human and
fundamental rights forces one to think, "is
there a planned move by those who does not want
to see this country intact and they are out to
attack and destroy the most powerful pillar of
Indian democracy?". For a layman it may be
another attempt to thwart the administration of
justice and create a sense of fear and
instability.
The recent
incident of killing of a young judicial officer
should be an eye opener for those with in the
country and ones deeming to be world powers as
they claim to be knowing price of every thing but
value of nothing especially administration of
justice in such conditions and of judges also who
are making every endeavour for upholding the
tenant democracy and justice. These are the times
when all in unison shall condemn such attacks on
the legal system and chant in unison, "Let
justice be done though the world perish",
because only a truthful and impartial analysis of
everything can bring to an end all the miseries
of people of whole of J&K State and such
exercise is possible only when the barbarians are
brought to the book and free fair and unthwarted
justice will be allowed to be imparted.
