Indo-Pak peace vital for prosperity in sub-continent,
says Farooq

Excelsior Correspondent

SRINAGAR, Oct 9: Chief Minister Dr Farooq Abdullah today said peace between India and Pakistan alone would bring prosperity in the region.

He was speaking on obituary references in the Legislative Assembly and Legislative Council in their autumn session that began here this morning.

Paying tributes to Begum Akber Jehan, Mr P R Kumaramanglam, Mtr. Zenab Begum and Justice I K Kotwal, who passed away during the intervening period between the special and the current session of the legislature, the Chief Minister said his mother and the towering stalwart of freedom struggle, Madr-e-Mehrban was concerned about the continued hostility between the two countries and feared a volcano like situation if peace was not given a chance.

Dr Abdullah said a united effort is needed for taking the nation to newer heights. Self-introspection is imperative for national development and the tendencies of intrigues have to be eschewed if democracy has to flourish, he said, adding, "We must learn to help each other".

Dwelling on the efforts of Begum Abdullah in the upliftment of weaker sections of society especially women, the Chief Minister said unless the lot of backward classes is improved, the State couldn’t progress. He referred to the tireless campaign launched by his mother in female literacy, welfare of gujjars and destitute. Gulzar-e-Itfal, he said was the outcome of her tireless efforts that provided much needed respite to poor.

Dr Abdullah said Madr-e-Mehran was highly religious women who encountered much travail when Sheikh Sahib was in prison and provided leadership to the masses who had waged a struggle for their rights.

Describing the former power minister, Mr P R Kumaramanglam as his personal friend, Dr Abdullah said the late leader evinced keen interest in power development of Jammu and Kashmir and as a result of his intervention an agreement was reached with the Centre for taping state’s hydel potential. Mr Kumaramanglam, he said, gave a new concept of BOOT that envisages transferring power projects to the State after the executing agency realises the costs incurred on these.

The CM said the MoU signed by him with the then union energy minister had been signed in good faith to benefit the state. However, later on the state officials pointed out some deficiencies. He immediately took up the matter with Mr Kumaramanglam who readily agreed. But, before correction could be effected, the cruel hands of death snatched him from us. "These clauses have to be modified to protect the interests of the State", he added.

The CM called for setting up of atomic power stations for bringing about a revolution in energy sector in the same spirit that led the country to green revolution. ‘This vast country has just five such power projects and the economic co-operation with countries like Russia should be utilized for more atomic power plants’, he said.

He described Mr Kumaramanglam as a sober and intelligent politician who would have gone much ahead but for his death.

The Chief Minister also paid tributes to Mtr. Zenab Begum and Justice Kotwal saying they would be remembered for their role in respective fields. Mtr Zenab did a lot during 1947 raid and in the awareness among women. She served the state in various capacities and was a minister.

He said Begum Sahiba played a pivotal role along side her illustrated husband Sher-e-Kashmir Sheikh Mohammed Abdullah against autocratic rule and for the just cause of the people of the state.

During the imprisonment of Sheikh Sahib, Begum Abdullah led the people, shared their miseries and earned the honour of Madr-e-Mehrban, he said, adding that she gave a new direction to the political movement and worked hand in hand with people and towering leaders from within and outside the state in restoring the basic rights of the people of Jammu and Kashmir. "Those who live for others never die," he said while remembering her tireless services towards the poor and down trodden people of the State.

Mr Vakil said that Madr-e-Mehrban is a part of state’s history who created awareness among women of the State particularly belonging to down trodden sections of the society.

He also paid homage to Mtr Zenab Begum and said that she was a self-less social worker who played an important role in Quit Kashmir movement.

Paying tributes to Mr P R Kumaramanglam, the Speaker said that he was keen to help the state to overcome power crisis and taping the rich hydel resources of Jammu and Kashmir that would create job opportunities for youth besides much needed power.

Forged Bank Draft case
Bail application of 2 accused rejected

Excelsior Legal Correspondent

JAMMU, Oct 9: City Judge Judicial Magistrate First Class Jammu, KJS Kanwal today rejected bail application of Anil Kumar and Ashok Sawhney of Haploo, Uttar Pradesh, who were arrested by Gandhinagar Police on September 17 last on a complaint filed by Manager of Indian Overseas Bank, Nanak Nagar Jammu for forgery and fradulently preparing two bank drafts for an amount of rupees 4,10,000, which were recovered from their possession.

The bail plea was opposed on the ground that their crime was serious in nature. It was pleaded that since the accused were needed for investigation, as they were associates of a big gang, as such they don’t deserve the bail at this stage.

While rejecting their bail pleas, the Judge held that this was a peculiar case as they have stolen the bank drafts and the signatures were forged on them.

It was pointed that the bank authorities have already issued circular about the misplacement of bank drafts and the specimen signatures of the accused have been sent to FSL authorities for comparison and their opinion has not sofar been received.

The judge held that in view of the facts and peculiar circumstances of the case, the bail plea is rejected at this stage.

Anwar Choudhary and S M Choudhary appeared for the accused, while’s Iqbal Singh, Chief Prosecuting Officer represented the State.

Bailable arrest warrants against Comm,
Director Edu for contempt

Excelsior Legal Correspondent

JAMMU, Oct 9: Justice Arun Kumar Goel of the State High Court has issued bailable arrest warrants against P L Raina, the then Commissioner cum Secretary School Education, Suresh Kumar, presently Director School Education Jammu, Brij Krishan Lidoo, Principal District Institute of Education and Training Basholi and Sudershan Singh Jamwal, Principal Higher Secondary School Raya Teshil Samba for procuring their presence in the Court on November 3, 2000.

While issuing warrants to the tune of Rs 10,000, the Justice took serious note for not complying with the court direction.

Noorul-Zaman Siddique had filed a contempt petition through Advocate Ruchi Bhakri as the respondents had failed to comply with the Court direction. Earlier Justice O P Sharma had directed the respondents to appear personally in the Court.

It at that time mentioned that the judgment of the Court dated May 14, 1999 was not implemented and the statement of the fact didn’t justify the delay in implementing the judgment." The delay in implementing the judgment is, therefore, not properly explained. The Director School Education Jammu is prima-facie in contempt unless the case of the petitioner is settled by him by the next date of hearing and the pension papers forwarded to the Accountant General for payment of retirement benefits and he will have to personally show cause why he should not be punished for committing the contempt of court", the court had earlier held.

However, the respondents didn’t comply with the court directive, forcing Justice Goel to issue bailable arrest warrants against them.

Noor-ul Zaman Siddique, senior lecturer had retired in December 1993, but the respondents failed to fix his pension in his favour. He had filed a petition in the Court which was decided by Justice Sharma on May 14, 1999 with the direction that full pension be released in his favour and the needful be done within three months, failing which arrears shall be payable to him, at the rate of 12 percent from the date of order.

ISI responsible for failure of HM-Centre talks: Shah

Excelsior Correspondent

SRINAGAR, Oct 9: Awami National Conference (ANC) president and former Chief Minister, G M Shah has supported the All Party Kashmir Hurriyat Conference offer of separate talks with India and Pakistan for a solution to the Kashmir issue.

Addressing a press conference here today,Mr Shah said that the dialogue must necessarily be held in an atmosphere of openness, sincerity and with the best interests of the people of J&K through tripartite settlement of the problem for which a conducive atmosphere is required be be created in the first instance.

Cease-fire offer by Hizbul Mujahideen had generated hope among the people in the State. He squarely held Pakistan’s Inter Services Intelligence responsible for the failure of the recent Hizbul-Centre talks.

"It was the ISI and the Government who scuttled the process," he said and added that the Vajpayee Government also failed on it.

People were for peace and "we all must work for creating an atmosphere for a permanent resolution of the Kashmir issue," he added, appealing to militants to keep the gun aside and take up the path of dialogue.

"Now is the time to sit across the table and find a solution with honour."

He said settlement of all outstanding problems was possible only through a dialogue which must necessarily be held in an atmosphere of openness, sincerity and with the best interests of the people of Jammu and Kashmir in mind.

To a question, Mr Shah, brother-in-law of Chief Minister Dr Farooq Abdullah, said the Kashmir issue could be resolved once and for all through tripartite talks, but before this, conducive atmosphere had to be created.

Since the Government of India was not ready for talks with Pakistan unless that country stopped militancy and Pakistan denies its involvement in Kashmir, the only way to bring India and Pakistan closer was to accept the offer of APKHC, he said.

Mr Shah said Kashmir was never an integral part of India and Central leaders should not shy away from this reality.

Criticising the Government for holding census, he said the process, at a time when a huge number of Kashmiri Pandits and Muslims were away from their homes, was "meaningless."

Thousands of people are supposed to have crossed to the other side of the border and a fair census was not possible in such circumstances.

When asked about the demand of some people in Jammu and Ladakh for division of the State, he said "I hate division and this will not be allowed."

Asked about the return of migrants to the Valley, the former Chief Minister said that Pandits are intergal part of Kashmir and our party will initiate discussions with KP leadership for their safe terurn. " Asli (Real) Mujahideen can only guarantee for their safe return", he said.

He however warned KP organisations like Panun Kashmir for demanding separate homeland. " We won’t let them toi carve a separate homeland. They have to be here with us", he asseted.

On autonomy, he said that it was a deceptive move on part of National Conference . Asked about his prospects to become the Chief Minister, he said " I sinned a lot after becoming CM"

HC sets aside order reverting KV teacher

Excelsior Correspondent

JAMMU, OCt 9: Justice T S Doabia of the State High Court has set aside the order of Assistant Commissioner, Kendriya Vidayalaya Sangathan, Jammu region by which the petitioner was relieved of her post as a Primary teacher and reverted to the post of Laboratory Attendant and later posted at KV Nangalbhur.

While setting aside the order dated June 22, 2000, the court observed that the respondents have, an indicated, put the cart before the horse." Without concluding the inquiry and without there being any inquiry report, the status of the petitioner as a teacher, which was a confirmed status, has been brought to the end", the Court observed, while disposing off the petition.

The Justice, however, said that the respondents are left free to continue with the inquiry and pass appropriate orders after affording reasonable opportunity to the petitioner. " The hurry with which the respondents have tried to conclude the present proceedings, is not apt. This is more so when the inquiry is held. It is not being suggested that there should not be quick departmental inquiry, but this quickness should not be at the cost of con-compliance of principles of natural justice", Justice Doabia further said.

Ranjana Vashistha, a teacher at KV Banbtalab had filed a petition against the order of the authorities by which she was reverted and posted as Laboratory Attendant at KV Nangalbhur on the grounds that she had allegedly produced fake B Ed certificate in support of her claim to become teacher from her earlier post. She was served the order of reversion, which she challenged in the Court of law.
