IOC completes survey 230 km pipe-line project

JAMMU, Jan 19: The Pipeline Division of Indian Oil Corporation (IOC) has completed detailed survey work on Rs 400 crore petroleum products Extension Pipe-Line Project. This 230 km long pipe-line will start from Jalandhar terminal and will be extended to Udhampur to carry petroleum products to various parts of the State.

This was stated by the Officials of the Pipeline Division of IOC at a meeting of officers of various State Government Departments here today. The meeting was chaired by the Minister of State for Food and Supplies Mr Ajay Sadhotra. The meeting was convened to discuss matters with regard to speedy land acquisition from private owners and Government Departments and sort out certain other related issues with concerned States Government agencies.

The meeting was informed that route for pipeline has been identified and it is expected that the project will be approved by June next. Necessary route maps and exact requirements of land at various places would be submitted to State authorities within 2-3 months for further action by them. The dumping of material for the project like pipes etc would start immediately after the project is approved this year while the work on ground is likely to start in September 2001. The work on the project is scheduled to be completed in next four years.

Addressing the meeting, the Minister of State for Food and Supplies urged the IOC authorities for taking immediate steps for speedy execution of the Project. He said all State Government agencies would extend all possible help to IOC to ensure early completion of the project. He said action for acquisition of 547 kanals of land have already been initiated. He stressed the need for posting a whole time Nodal Officer at Jammu by Indian Oil Corporation for co-ordinating the land acquisition another matters speedily.

Commissioner Secretary Mr R K Jerath, Director Food and Supplies, Jammu Mr S C Jandial, Project and Divisional Manager of IOC and Senior Officers of Revenue and Works Department participated in this meeting.

The fair is being organised by National Council of Science Museum at National Science Centre Pragati Maidan, New Delhi from January 20 to 22.

ASKPC holds meet

JAMMU, Jan 19: A meeting of All State Kashmiri Pandit Conference (ASKPC) was held under the chairmanship of Mr Amarnath Vaishnavi in connection with observance of 11th Exodus Day here today.

As per a release, the meeting alleged that the sufferings of the displaced community have not decreased over the last ten years and both the Central and state governments have failed to open the doors for the employment of KP youth.

The meeting said the claims of traders, fruit growers have been ignored and exgratia for the gutted properties has been stopped.

The meeting said thousands of families are still living in rented houses. The meeting urged the Central Government to raise from the deep slumber and look into the problems of the displaced people.

Rs 27.73 lakh sanctioned to militancy-hit

ANANTNAG, Jan 19: District Screening Committee for Anantnag has sanctioned Rs 27.73 lakhs in favour of militancy-hit victims.

According to an official spokesman, the meeting which was held under the chairmanship of the Deputy Commissioner, Anantnag Mr Pawan Kotwal today, cleared 32 cases related to militancy. Besides senior officials in the District Administration, representatives from Army, Border Security Force, Police and Central Reserve Police were also present in the committee meeting.

Of the total sum, Rs ten lakhs have been sanctioned in favour of ten next of kin of those killed persons in militancy related incidents while Rs 17.73 lakhs were sanctioned in favour of 18 property damages cases. The Committee also sanctioned Rs 20,000 in favour of four injured persons in such incidents. Besides this, Rs 2 lakhs have been sanctioned in favour of two migrant families whose property was damaged in militancy related incidents.

Kashmir CCI decry power crisis in Valley

SRINAGAR, Jan 19: The Kashmir Chamber of Commerce and Industry has strongly criticised the State Government for absence of power supply in the Valley.

In a press release issued here today, the Chamber expressed anguish over the power supply position and said it has added to the woes of the general public during the winter months. It was stated that despite hike in power tariff the curtailments have sharply risen up.

The power crisis has adversely affected the life in the Valley. The people are concerned about the attitude of the authorities towards their hardships.

The prolonged State Government employees’ strike has further compounded problems of the people, the release said and added that the Government should move in the matter and redress hardships immediately.

"Homeland" answer to all problems: Shakdhar

JAMMU, Jan 19: The demand for separate "Homeland" with Union Territory status within Kashmir Valley was reiterated at Kashmiri Pandit Youth convention which was held in connection with observance of 11th holocaust Day here today.

Addressing the delegates Mr Sunil Shakdhar, general secretary, Kashmiri Samiti Delhi said the "Homeland" should be goal of every uprooted Kashmir Pandit who after being hounded out from the Valley on the point of gun has lost his birth place.

He while saying the "Homeland" is the only answer to all problems being faced by the displaced community appealed all factions of Panun Kashmir and other KP bodies including the Kashmiri Yuvak Sabha to join hands in achieving this goal.

Justifying the demand he said when Bihar can be divided on the name of Jharkhand and UP on the name of Uttrakhand why Kashmir can not be divided to carve out a separate Homeland for KPs who have been forced to become refugees in their own country.

Mr Shakdhar asserted that "Homeland" is still an issue with the Government and it needs only unified struggle on the part of Community to achieve this goal.

The KPs are not at the agenda of Government at present, he alleged, adding this is the main reason that issues pertaining to them were not discussed in Advisory Committee meeting at Delhi day before yesterday.

Making a scathing attack on Dr Farooq Abdullah Government he said the Kashmiri Pandits have lost their total faith in him as he over the years has failed to address the issues being faced by the Community.

He alleged that Farooq Abdullah does not want to even distribute the relief money which his Government receives from Centre and demanded separate budget be kept for KPs.

Lambasting the Hurriyat Conference he ruled out that efforts were ever been made by his organisation to hold dialogue with its representatives.

In his address former Director General of Police Mr Manmohan Khajuria said the community has itself to fight for its rights.

He said many questions are being raised on the return of the community to Valley. Though the elderly members from the majority community will feel no problems yet the younger generations who have the influence of fundamentalist forces are not ready to accept them.

Mr Khajuria said the community instead of depending on others for help should itself launch a decisive battle for their rights.

He said it is up to the community to think whether they want to remain as a problem or become the solution of the problem.

He said no body is ready to give you the status of 1947 refugees or take measures for your rehabilitation and hence the new generation from the community has to ponder over the issue and find its solution.

Speaking on the occasion, Mr Ashwani Kumar Charangoo, president Panun Kashmir Movement which has sponsored the convention expressed the hope that youth attending this seminar will come with concrete proposals to face cultural and social challenges.

He alleged that even after the 10th year of exile the KP community is facing many problems at social and cultural level. He asked the youth of the community to come forward and meet the challenge decisively.

He said the social and cultural roots are to be strengthened with innovative motivations and transformed social awakening.

He said the youth of the community need to go to the extent to create a new style and system of functioning which creates hope for generations to come.

Advocating strongly for the "Homeland" demand Vice Marshal (retd) B K Chaloo who was the chief guest on the occasion said the community should now make a decisive battle to achieve this goal.

He said KPs are in minority in Jammu and Kashmir state and hence deserve the minority status.

On the occasion agenda paper for discussion was presented by Dr Vijay and those who participated in the discussion include Messrs Raj Kumar Khazanchi, Marnal Koul and Miss Nimfia Koul.

Deep in the jungles, Dakoda tears the Earth crust, and surfaces in a fiery and boiling form. He begins his search for Shaktimaan and sets off in a flaming form towards the city. On his way, Dakoda vaporises and turns to ash, whatever that comes in his path.

Municipal employees condemns attack on women workers

JAMMU, Jan 19: The Joint Action Committee of Civic Safai Karamcharis Union, Drivers and Cleaners and Operators Union and Civic Safai Karamcharis Union (Migrant Camps) held a meeting here today under the leadership of George Brut to discuss the present situation created due to the strike launched by Municipal workers including Safai Karamcharis.

As per a release, the meeting condemned the attack by some civilians on the striking Municipal women workers at Municipal Office here. The authorities of the Municipality were warned that workers will not tolerate such sponsored attacks and retaliate.

The meeting alleged that the workers were attacked in presence of police who acted as mute spectator.

Massive demonstration in Rajouri, 55 arrested

RAJOURI, Jan 19: The work in all the government offices remained paralysed throughout the day in the entire district on 31st consecutive day today whereas, at least 55 striking employees were picked up by police while they weredemonstrating on the roads to defy restrictions imposed by the Magistrate.

Worst is the condition observed in government hospital which has virtually turned into a hell. Only emergency services are available to the patients. The employees have extended full support to the Employees Joint Action Committee.

The employees kept sitting in their respective offices on protest dharna and at some places they held demonstrations, raising slogans against the government. A massive rally was also held at DIET office complex during afternoon here where hundreds of employees participated.

Thereafter, the employees came out on the road. After passing through various localities the protest march culminated at Dak Bungalow, defying restrictions imposed under Section 144 CrPC. The police intervened enroute but they break and barricades and moved ahead. Several leaders also addressed the rally.

At least fifty five employees were taken into custody by police at various places during demonstrations in the district today. Several employees were also arrested at Thana Mandi and Darhal. The members of the EJAC have condemned the arrest of the employees and the harassment of the striking employees by police.

Those spoke on the occasion here included Khurshid Mir, Nagesh Sharma, Afzal Lone, Fazal Chowan, Vijay Kochar, Karamat Malik, Farooq Mirza, Vijay Sharma, Sadiq Chib, Amjad Mir and others.

Govt clarifies invocation of ESMO

JAMMU, Jan 19: A number of statements have been issued by well meaning citizens including advocates questioning the viries of the Essential Services (Maintenance) Ordinance-2001 (Ordinance No. IX of 2001). It has been argued that after promulgation of the State Constitution in 1957 an ordinance can be issued only in terms of Section 91 of the Constitution of Jammu and Kashmir State. "This is indeed the present position," an official spokesman said today.

However this is not true of the Essential Services (Maintenace) Ordinance 2001 as in that year, an ordinance could be issued under the section 38 of J&K Constitution and also under Section 5 of J&K Maharaja of J&K by exercise of powers under Section 38 of the Constitution of the State. This ordinance was to lapse after 6 months of having been passed. The Ordinance which was issued to replace this ordinance was under Section 5 of then Constitution of the State of Jammu and Kashmir which reserved the legislative powers to be exercised by Maharaja under the then Constitution. By virtue of powers vested in Maharaja under Section 5 of then Constitution it was to be the legislation passed by Maharaja by exercise of such powers. For ready reference section 5 of the then Constitution is reproduced below.

"Notwithstanding anything contained in this or any other Act, all powers, legislative, executive and Judicial, in relation to the State and its Government are hereby declared to be and to have always been inherent in and possessed and retained by His Excellency and nothing contained in this or any other Act shall affect or be deemed to have affected the right and preorgative of His Highness to make laws, and issue proclamations, orders and ordinance by virtue of His inherent authority."

The spokesman said, the present Essential Services (Maintenance) Ordinance of 2001was thus a law enacted in terms of the above power exercisable by the then Maharaja and in present case by him and him alone and such laws were saved by Section 157 of the Constitution of J&K as was adopted in the year 1957. Sub Section(2) of Section 157 of Constitution of J&K State is reproduced below:-

"Notwithstanding the repeal of the said Act but subject to the other provisions of this Constitution, all the laws in force in the State immediately before the commencement of this Constitution shall continue in force until altered or repealed or amended by competent authority."

The Essential Services (Maintenance) Ordinance 2001 being law on the date of adoption of the 1957 Constitution was thus saved and remains in force until is altered or repealed or amended by competent authority. There should be no misgiving or misunderstanding on this matter, he clarified.

Repressive measures against employees condemned

JAMMU, Jan 19: Joint meeting of the representatives of Central Public Sector and Departmental Sector was held today at Jammu to take stock of the situation arising out of attitude of State administration in handling the ongoing strike by its employees.

The meeting criticised the Government for invoking ESMO and given free hand to the police to unleash a reign of terror. The brutal lathicharge and firing tear gas shells on the employees gathering resulted into grievous injuries to a large number of employees. Even female employees are not spared. Misbehaviour of a infamous lady police official with female representative of employees in Women Cell is highly deplorable.

The union leaders while pledging full support to the striking employees urged the Government to immediately revoke ESMO to create congenial atmosphere and invite employees leaders for purposeful dialogue to reach an amicable settlement to defuse the situation which is creation of the Government.

The meeting was chaired by KK Bakshi, convenor, Coordination Committee of Trade Unions, Roop Lal, chairman, Confederation of Central Government employees and attended by Romesh Chander, Daljeet Singh, PN Koul, BN Sharma, SK Raina, AK Jain, VK Bakshi, RS Jamwal, Bishan Dass, Ashok Angural, KK Sharma, Kishore Chand, Surinder Singh, Kewal Krishan, Gittan Singh, Rajesh Badyal, Satish Kumar, PK Koushik, Madan Gopal, Bashir Ahmed, Rajesh Choudhary, Raj Kumar and Dalip Koul.

Employees hold demonstrations

RAJOURI, Jan 19: The employees held a demonstration here today in protest against the suppressive measures adopted by the Government against them.

The demonstration was held at Jawaharnagar here which besides others was addressed by Messrs Khurshid Mir, Sadiq Khan, Farooq Mirza, Shashi Sawhney and Fazal Chowhan. The employees also shouted slogans against the lathicharge on the peaceful demonstration at Jammu.

Another rally was held at Kalakote under the banner of EJAC. The rally was presided over by Mr Hem Raj Bharma. It started from Thermal ground and concluded at Tehsil Office.

Addressing the demonstrators the employee leaders urged the Government to solve their long pending demands immediately.

Sharma’s plea to striking employees, Govt

JAMMU, Jan 19: Senior Congress leader and former MP Mr Mangat Ram Sharma has urged the Government to find an amicable solution to employees demands. He also appealed to striking Government employees to suspend their strike in view of the coming Republic Day function.

Mr Sharma expressed the hope that employees in the general interests of the nation will suspend the strike so that the Republic Day function passes peacefully.

Meanwhile, PCC secretary Mr Raman Bhalla has also urged the Government to solve the employees demands immediately. He strongly condemned the repressive measures taken by the Government against the striking employees saying that such a step will have serious consequences.

The PCC leader criticised the State Government for its failure in restoring the power supply to Poonch district and alleged that the entire area is facing complete black out due to snapping of transmission lines. He demand immediate measures for restoring power supply to the border district.

Cong leaders hold rally

JAMMU, Jan 19: The Congressmen pledged and took a stand to fight against corruption, unemployment, terrorism and anti-employees policies of the National Conference Government.

As per a release this resolve was made in an impressive and massive rally held at Bishnah today under the chairmanship of Mr Ashwani Kumar Sharma, a local Congress leader.

The rally passes through the main streets of the town as a part of Sankalp Yatra which reached here early in the morning from Vijaypur. the rally was led by Mr Shiv Dev Singh and Mr Lal Muni Sharma from Jammu, Nagrota and Dansal and by Ch Munshi Ram from Vijaypur and Ch Garu Ram and S Rajinder Singh from R S Pura, which was received by Pandit Mangat Ram Sharma and Ashwani Sharma of Bishnah.

While speaking on the occasion Mr Mangat Ram Sharma said, "we have to fight against poverty. he said sankalp yatra has started from different states and would reach Rajghat on January 30. He made an appeal to the employees that if the strike continues they will have to work on January 26 to make the celebrations successful. He also asked the Government to solve the problems of the employees.

While addressing Mr Ashok Kumar Sharma, MLA and chief whip of Congress Legislature Party presented a charge sheet against the national Conference Government before the people’s court charging Farooq Government with corruption, inefficiency, anti-ecology, greedy, based on nepotism, favouritism and communalism. He said that employees strike fore the last over 30 days was because of follies of the NC Government. He urged on the State Government to intervene and settle the demands of the employees on a negotiation table.

While addressing Mr Raman Bhalla charged the State Government with encouraging terrorism in the State and said that such misrule cannot be allowed to function any further. He also charged the State Government with financial mismanagement which has resulted into severe financial crunch.

Mr Ashwani Sharma explained the purpose of Sankalp Yatra and administered pledge to the people to fight for justice, eradication of corruption, employment to the educated youth and right of people.

Lathicharge, arrest of employees condemned

JAMMU, Jan 19: Various employees organisations have condemned the brutal lathicharge on employees and arrest of the employees by police from different areas.

The Ministerial Education Forum has expressed solidarity with the genuine demands of the employees and criticised the anti-employees policy of the Government regarding its rigid stand in solving their problems.

As per a release the speakers condemned the use of brutal force on employees and for not providing basic amenities to the arrested employees.

Agricultural Technocrat Welfare Forum in a meeting today condemned the lathicharge and teargassing by police on employees and called for immediate negotiations to end the ongoing strike. The speakers included Messrs Rajesh Gandotra, Romesh Sharma, Rajesh Langer, Ajay Saproo, R K Sharma, Sadesh Koul, S C Thappa, Ravi Sharma and Pardeep Singh.

Bar Association Samba in a meeting strongly condemned use of force by State administration on its employees and also flayed the imposition of ESMO and Section 144 CrPC. The Bar impressed upon the striking employees and the Government to settle the issue immediately through negotiations keeping in view the hardships being faced by the common man.

Mr H D Qureshi, former general secretary of All J&K Plus 2 Lecturers Forum has congratulated the employees for their exemplary unity and held that the employees struggle was near to victory. He condemned use of force against employees and demanded immediate release of arrested employees. He appealed the people from all walks of life to support the strike and pressurise the Government for resumption of meaningful dialogue for settlement of demands.

State Information Employees Association met here to condemn the arrest of some of the Government employees including two of their sincere and dedicated union leaders Messrs Mela Ram Sharma and Noor Mohammad Bhat by police yesterday while they were on their way to office. The meeting expressed anguish over arrest of innocent and peace-loving citizens who have put in most of their life span in the interest of the Government work at different levels.

JAKEDA Non-Gazetted Employees Union convened a meeting under the presidentship of S Gurdeep Singh, in which the speakers flayed the Government for imposition of ESMO, which has not been ratified by the State Assembly. The speakers also condemned the use of brutal force by the Government as also its cryptic silence vis-a-vis demands of the employees. The speakers and other office bearers who also participated in the strike included Messrs Mohan Lal, Ms Hina Ganjoo, Ravi Kumar, Deepak Sharma, Rajinder Singh, Chintan Kumar, Mrs Mohini Arora, Shakuntla Devi, Abbas Badar-ud-Din, Dev Raj, Badri Nath, Parshotam Singh, Ashfaq Ahmed, Kartar Singh, Bashir Ahmed, Vinod Kumar, Anil Kumar, Om Parkash, Chain Singh and Shamsher Singh.

A joint meeting of All J&K Non Gazetted and Forest Ministerial Staff Association under the chairmanship of S Jaswant Singh criticised the State Government for not fulfilling the genuine and old pending demands of the state employees. the meeting appealed the Government to accept the genuine demands of the employees to avoid further inconvenience to the people and not compel the employees to stop essential services.
